FOR A VALUABLE CONSIDERATION, the undersigned,
NORMAN L. MAC LEOD. JR. AND MARILYN M. MAC LEOD. HUSBAND AND WIFE AND CLAY
ELKIN MAC LEOD. A SINGLE MAN AND CAROLYN ELKIN MAC LEOD. A SINGLE WOMAN
hereinafter designated Grantors do hereby grant, bargain, sell, convey and
release unto the CARDIFF SANITATION DISTRICT herein designated GRANTEE, its
successors and assigns, a perpetual easement and right-of-way for ingress and
egress on and across, and along herein described real property for personnel
and equipment. GRANTEE shall have a perperpetual right to remove buildings,
structures, trees, bushes, undergrowth, and any other obstruction interfering
with the use of said easement and right-of-way by the GRANTEE, its successors
or assigns. To have and to hold said easement and right-of-way unto itself
and unto its successors and assigns forever, together with the right to convey
said easèment, or any portion of said easement, to other public agencies.
The Real Property referred to herein and made subject to said easement and
right-of-way by this grant is situated in the City of Encinitas, County of San
Diego, State of California, and is particularly described as follows:
A STRIP OF LAND, 15.00 FEET IN WIDTH, OVER, ALONG AND ACROSS A PORTION OF THAT
LAND DESCRIBED IN DEED TO NORMAN L. MAC LEOD, ET AL, RECORDED IN THE OFFICE OF
THE COUNTY RECORDER OF SAN DIEGO COUNTY APRIL 1, 1982 AS FILE/PAGE NO. 82-
088292; THE ALIGNMENT OF SAID STRIP OF LAND TO BE ALONG THE EXISTING GRADED
TRAVELLED WAYS ON THE SUBJECT PROPERTY GENERALLY SHOWN AND DEPICTED ON EXHIBIT
