application with the following modifications: 1) Change
Condition No.3 to allow the existing palm and Bird of

to remain, and 2) Require an indemnification condition to be
recorded on the property holding the City harmless for any
complications or accidents which may allegedly result from the
approved parking arrangement.

BUSINESS
A.
Request for direction from the board related to Case #90-
161 BA (David Shaw) and Condition No. 12 of the
Resolution approving the boundary adjustment for property
located at 1905/1917 Oxford Avenue.
The Board directed the property owner to either seek an
amendment to the boundary adjustment to reduce or
eliminate the need for a variance or to submit a complete
application (with design plans) for consideration of a
rear yard variance for the garage. The Board affirmed
that access from or near the alley for the northerly lot
was necessary due to the lot's location.
