ORAL COMMUNICATIONS Dennis Ferlito spoke to the Community Advisory Board on two issues: 1) Asked whether the City has a view preservation ordinance. Staff responded that if developments adhere to the standard height envelope than the project for a single family residence may be approved without Design Review approval; and 2) Whether a new development is required to contain drainage on-site. CASE NUMBER: 90-039 MIN/V APPLICANT: Graves/Resor LOCATION: 2471 Newport Avenue DESCRIPTION: Minor Use Permit for Accessory Apartment ("Granny Flat") and Variance to allow a 4 foot encroachment for an upper level deck into the front yard setback. ENVIRONMENTAL STATUS: Exempt from Environmental Review - Section 15301(e) (1) of CEQA. Motion: Board Member Tom McCabe - To approve the project, as per staff recommendations, with the following conditions: 1. Code Enforcement shall inspect the site twice, at six- month intervals, to verify that all occupancy requirements are met; 3. Balcony and garage shall not be converted to living space and garage shall be kept clear to allow its continued use for the parking of vehicles; 4. Deck is to remain entirely open above the upper level of the safety railing (including any "clear" enclosure materials); 5. staff to verify that the traffic arrangement as proposed is acceptable to the City Traffic Engineer. Conditions 3 and 4 above shall be a part of the recorded Use Permit and Variance approvals for this project.
