C-93-04 A RESOLUTION OF THE CARDIFF COMMUNITY ADVISORY BOARD DENYING AUTHORITY TO EXCEED THE STANDARD HEIGHT ENVELOPE FOR A PROPOSED ADDITION TO AN EXISTING SINGLE FAMILY RESIDENCE FOR PROPERTY LOCATED AT 2030 GLASGOW AVENUE (CASE NUMBER 93-150 DR) WHEREAS, a request for consideration of authority to exceed the standard height envelope was filed by Mr. Ron Carlson to allow a proposed addition to a single-family residence to be a maximum 30 ft. in height in accordance with Chapter 30.10 of the city of Encinitas Municipal Code, for the property located in the R-11 zone at 2030 Glasgow Avenue, legally described as: Lots 9 and 10 in Block 40 of Cardiff "A", in the County of San Diego, State of California, according to Map thereof No. 1334, filed in the office of the County Recorder of San Diego County May 10, 1911. WHEREAS, a public hearing was conducted on the application on August 30, 1993, by the Cardiff Community Advisory Board; and WHEREAS, the Board considered: 1. The August 30, 1993 staff report to the community Advisory Board with attachments; Application and project plans dated received July 30, 1993; Oral evidence submitted at the hearing; written evidence and photos submitted at the hearing; and 2. 3. 4. WHEREAS, the Community Advisory Board made the following findings pursuant to Chapters 30.10 of the Encinitas Municipal Code: (SEE ATTACHMENT "A") NOW, THEREFORE, BE IT RESOLVED that the Community Advisory Board of the City of Encinitas hereby Denies application 93-150 DR. ATTACHMENT "A" Resolution No. C-93-04 Case No. 93-150 DR Applicant: Ron Carlson Findings: Conclusion (Code Section, Factual Circumstances, Reasoning, section 30.16.010 (B.7) reads as follows: "Buildings may be approved through the Design Review process for a maximum height of 30 ft. if it can be found that the portion of the building outside the standard envelope maintains some of the significant views enjoyed by residents of nearby properties, and that the building is compatible in bulk and mass with buildings on neighboring properties. II Facts: The applicant proposes to add an approximate 10' x 13' tower feature with roof deck to be constructed above a proposed 2nd story addition to the home, which would rise to a maximum 30 ft. above grade. The site presently contains numerous tall, mature trees, such that the existing home is not readily visible from public areas. Discussion: Based upon the evidence presented at the hearing including the application, staff report, testimony and photos presented, the Board determined that although the abundance of tall mature trees on site presently obstructs much of the views westward through the property, those trees, maintained by the applicant, create a view impediment which is temporary in nature and construction of the proposed tower to 30 ft. could impact significant views enjoyed be nearby residents and thus should not constitute a basis upon which the applicant should be allowed to exceed the standard height envelope pursuant to Section 30.16.010 (B.7) of the Municipal Code. Conclusion: Therefore, the Board finds that construction of the addition as proposed could adversely impact the significant views enjoyed by other properties in the area. TC/8/93150DR.RES (9-21-93)
