1989-24 RESOLUTION NO. OE89-24 A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT TO ALLOW A SIGN PROGRAM FOR THE PROPERTY LOCATED AT 315 FIRST STREET (CASE NUMBER 89-211SPRO) WHEREAS, a request for consideration of a Design Review Permit was filed by Mr. Paul Rotsheck to allow a sign program in conjunction with Moonlight Plaza Phase 2 as per Chapter 23.08 of the City of Encinitas Municipal Code, for the property located at 315 First Street, legally described as: Lots 9 through 12, Block 57 and the northerly one half of "C" Street (as vacated), per Map 148, along with a portion of Section 16, T13S, R4W, San Bernadino Meridian; and WHEREAS, a public hearing was conducted on the application on October 26, 1989, and; WHEREAS, the Community Advisory Board considered: 1. 2. 3. 4. The staff report dated October 12, 1989; The application and project plans submitted by applicant; Oral evidence submitted at the hearing; written evidence submitted at the hearing; and WHEREAS, the Old Encinitas Community Advisory Board made the following findings pursuant to Chapter 23.08 of the Encinitas Municipal Code: The proposed project signing is in scale with the buildings, is constructed of weather resistant and durable materials, is compatible with the approved buildings in terms of color, avoids excessive contrast in color and lighting and is otherwise in substantial conformance with the City's Design Review Guidelines related to signing. NOW, THEREFORE, BE IT RESOLVED by the Old Encinitas Community Advisory Board of the City of Encinitas that application 89-211SPRO is hereby approved subject to the following conditions: (SEE ATTACHMENT "B") BE IT FURTHER RESOLVED by the Old Encinitas Community Advisory Board of the City of Encinitas that: CCj04jCR04-384wp5 (12-04-89-2) This project was found to be exempt from en ironmental review pursuant to Section 15311 of the State CEQA Gui elines. RESOLUTION NO. OE89-24 STANDARD CONDITIONS ATTACHMENT "B" Rotsheck 89-211SPRO Sign Program for Moonlight Plaza Phase 2 315 First Street SPECIFIC CONDITIONS A. The applicant shall keep on file, to the satisfaction of the Community Development Department, a master sign program showing wall signs in the approved locations not to exceed (cumulatively) 182 sq. ft. for the larger north building and 80 sq. ft. for the smaller south building. B. The illumination of the proposed directory sign shall be reduced in intensity by a factor of approximately one half, relative to the existing similar directory sign for adjoining Moonlight Plaza Phase 1, to be verified by the Community Development Department prior to final approval. STANDARD CONDITIONS 1. GENERAL CONDITIONS A. B. c. This approval will expire in two years, on October 26, 1991, at 5:00 p.m. unless the conditions have been met or an extension has been approved by the Authorized Agency. This approval may be appealed to the authorized agency within 15 calendar days from the date of this approval. In the event that any of the conditions of this permit are not satisfied, the Planning and Community Development Department shall cause a noticed hearing to be set before the authorized agency to determine why the City of Encinitas should not revoke this permit. Upon a showing of compelling public necessity demonstrated at a noticed hearing, the City of Encinitas, acting through the authorized agency, may add, amend, or delete conditions and regulations contained in this permit. E. Nothing in this permit shall relieve the applicant from complying with the conditions and regulations generally imposed upon activities similar in nature to the activity authorized by this permit. F. Nothing in this permit shall authorize the applicant to intensify the authorized activity beyond that which is specifically described in this permit. G. Approval of this request shall not waive compliance with any sections of the Zoning Development Code and all other applicable City Ordinances in effect at the time of Building Permit issuance unless specifically waived here. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit issuance unless specifically waived here. Permits from other agencies will be required as follows: a. Coastal Commission Except for the proposed directory sign, signs are approved as submitted and as shown on the plot plan dated September 11, 1989. The signature of the appropriate staff will attest to the approval. APPLICANT SHALL CONTACT THE ENCINITAS FIRE PROTECTION DISTRICT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 3. FIRE A. Prior to final recordation, the applicant shall submit a letter from the Fire District stating that all development impact, plan check and/or cost recovery fees have been paid or secured to the satisfaction of the District.
