A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY
CITY OF ENCINITAS, APPROVING A LANDSCAPE
PLAN FOR MOONLIGHT PLAZA PHASE 2,
LOCATED AT 315 FIRST STREET
(CASE NUMBER 87-050 MUP)
BOARD
WHEREAS, a request for consideration of a landscape plan was
filed by Paul Rotsheck in accordance with the Planning Commission
Resolution of approval for the associated development proposal
(Res. 88-05) and in accordance with Chapter 23.08 of the city of
Encinitas Municipal/Zoning Codes, for the property located at 315
First Street, legally described as;
Lots 9, 10, 11 and 12, Block 57 and northerly one half of "C"
Street (as vacated), per Map of Encinitas, Map 148, along with
portions of section 16, T13S, R4W, San Bernardino Meridian.
WHEREAS, a public hearing was conducted on the application on
March 9th and 23rd, 1989, and
WHEREAS, the Community Advisory Board considered:

The staff report dated February 9, 1989;
2.
The application and landscape plan dated received March
14, 1989 submitted by the applicant;
3.
Oral evidence submitted at the hearing;

wri tten evidence and an additional colored landscape plan
submitted at the hearing; and
WHEREAS, the Old Encinitas community Advisory Board found that
subject
to
the
conditions
of
approval
contained
herein,
the
proposed landscape plan is consistent with the city's Design Review
Guidelines
pertaining
to
landscaping
and
that
none
of
the
regulatory conclusions contained in Sect. 23.08.077 can be made in
this instance.
NOW, THEREFORE, BE IT RESOLVED by the Old Encinitas community
Advisory Board of the city of Encinitas that the landscape plan for
87-050 MUP is hereby approved subject to the following conditions:

Board of the city of Encinitas that:

This was found to be consistent with the proj ect' s
Negative Declaration of environmental impact certified
by Planning commission Resolution No. 88-05.

This approval will expire on March 23, 1991, two years
after the approval of this project unless the conditions
have been met or an extension has been approved by the
Authorized Agency.
This approval may be appealed to the authorized agent
within 10 days from the date of this approval.
In the event that any of the conditions of this permit
are not satisfied, the Planning Department shall cause
a noticed hearing to be sent before the authorized agency
to determine why the City of Encinitas should not revoke
this permit;
Permits from other agencies will be required as follows:
Project is approved as submitted/modified and shall not
be altered without Old Encini tas Community Advisory Board
review and approval.
LANDSCAPING

A detailed landscape and irrigation plan shall be
submitted to and approved by the Community Development
Department Board prior to the issuance of building
permits as consistent with the Community Advisory Board
approval.

The landscape plan shall meet the standards of the zoning
Ordinance, Grading Ordinance and off street Parking
Design Manual and is approved as submitted subject to the
following modifications:

All Hibiscus and Tenax "Tiny Tim" shrubs shown on
the landscape plan shall be of a minimum 5 gallon
size.

Box trees, but shall match the species of street
tree used on the site on Moonlight Plaza Phase 1
adjacent to the south.

The front "turf" area indicated near the street
corner shall be planted with Mondo grass (Ophiopogan
japonicus) planted at 6 inches o.c. with areas of
color plantings interspersed.
4.
The Eucalyptus trees in the rear (east) portion of
the site shall be specified at a spacing of a
minimum 7-10 ft. on the detailed landscape plan and
shall be clustered to permit visual corridors
through to the east.

DRAINAGE AND FLOOD CONTROL

A drainage system capable of handling and disposing of
all surface water originating within the subdivision, and
all surface waters that may flow onto the subdivision
from adjacent lands, shall be required. said drainage
