'0-238 TPM/Bft) WHEREAS, a request for consideration of time extension for Tentative Parcel Map 88-230 was filed by L' Imaqe Development Group for conversion of a duplex into a one lot condominium form of ownership for property located at 2527/2529 Manchester Avenue, legally described as; Lots 41 and 42 in Block 2 of CARDIFF, according to Map thereof No. 1298, filed in the Office of the County Recorder of San Diego County, November 14, 1910. WHEREAS, public hearings were conducted on the application on November 26, December 10, 1990 and January 28, 1991, and; WHEREAS, the Community Advisory Board considered: 1. The staff reports dated November 21, December 5, 1990, 2. and January 23,1991; The Tentative Parcel Map submitted by the applicant and 3. dated received by the City on October 3, 1990; Oral evidence submitted at the hearings; 4. Written evidence submitted at the hearings; and WHEREAS, the Cardiff-by-the-Sea Community Advisory Board made the following findings pursuant to Section 24.50.130 of the City of Encinitas Subdivision Ordinance: (see ATTACHMENT .. A" ) NOW THEREFORE, BE IT RESOLVED that a time extension request for Tentative Parcel Map #88-230 is hereby approved subject to the following requirements: CO/04/CRO8-687wp51(1/30/91-3) 1. 2. All conditions of Resolution No. C-88-044 satisfied prior to Final Map approval. Pursuant to City of Encinitas Subdivision Ordinance 24.50.130, the Final Parcel Map must be recorded in substantial conformance to Tentative Parcel Map 88-230 within 12 months of the expiration date of the original approval (November 14, 1991), or this approval will no longer be valid. shall be Applicant shall secure an encroachment permit for the stair structure which encroaches into the public right- of-way. In lieu of securing said encroachment permit, applicant shall remove the stair structure from the right-of-way prior to final map recordation. BE IT FURTHER RESOLVED that this project is exempt from 3. '0-238 TPM/8ft Findings pursuant to Section 24.50.130 of the City of Encinitas Subdivision Ordinance: 1. The Tentative Parcel Map and conditions of approval remain substantially unchanged. Bvidence: The Cardiff Community Advisory Board finds that the Tentative Parcel Map submitted with the extension request is substantially unchanged to the originally approved Tentative Map. The Board can identify no reason why any conditions of Resolution C-88-044 would need to be amended. 2. A need exists to attached additional development fees. Bvidence: Condition #8 of Resolution C-88-044 requires the applicant to remit appropriate impact fees pursuant to Chapter 23 of the Municipal Code. Each City Department is responsible for collection of appropriate fees prior to Final Map authorization. 3. A need exists to alter map design or number of units. Bvidence: The map extension request is substantially unchanged to the original submittal and no additional units beyond the original duplex are associated with the time extension request.
