The Sign Ad Hoc Committee has requested that the Council increase
enforcement positions to:
1.

1 full-time
1 part-time (weekends and 1 day a week to focus on sign
enforcement)

Two full-time officers (one of which to concentrate on
signs)
DISCUSSIOB:

The sign committee has identified a need for two full-time Code
Enforcement Officers. However, some alternatives are available
to supplement the existing full-time enforcement position with
one part-time employee (20 hours per week) and a consultant to
provide an informational program on signs.
The full-time Enforcement Officer would be responsible with
public contact, coordinating violations and follow-up to ensure
compliance, prepare abatement programs/procedures and the like.
One of the maj or time consuming duties of a Code Enforcement
Officer is field work. It is proposed that the part-time
employee would handle most of the preliminary and follow-up field
work. '
A sign informational program similar to the program utilized in
Solana Beach would be beneficial. Solana Beach recently retained
a consultant to contact each of the merchants and personally
review the sign regulations prior to any enforcement. It was
approximately a 6 week program and considered successful. One
comment made by the City was the need to follow up the
informational program with enforcement.

Madam Mayor and City Council:
Prior to the resignation of Mark Bauman, and especially now that
he has left, the sign committee feels that sign code enforcement
has decreased below the level that was provided by the county. Not
only is the city without any code enforcement officer, at the
present time, the sheriff's department will no longer handle sign
complaints as sign code enforcement should be handled by city
staff.
It has been determined by inventory [see attached letter) that we
now have more signs in violation since the city has taken over
enforcement. This is due in part to the workload that was placed
on our codes enforcement officer and lack of knowledge on the part
of violators. Therefore, it is requested that a minimal of one
full-time and one part-time (signs only), or 2 tULL-TIME codes
enforcement officers be hired, as soon as possible.
One of these officers would work the weekends and one day during
the week to handle SIGN CODE VIOLATIONS ONLY. They would inventory
signs, educate the businesses on the code and field questions
regarding signs. If empowered with enforcement authority, they
could be directed to remove signs found in violation by the city.

The below listed signs are believed to be in violation of C.P.C.
Sec. 556. It has been requested that the Sheriff's Department
isSue warning citations for the signs in the public right-of-way
to include, but not by way of limitation, those listed and to send
a copy to us for filing purposes. If the owner can't be determined
then take appropriate action to abate the violation.
The first group of signs are located on the West side of Highway
101 in Leucadia. Starting at the North end and proceeding South on

PURPOSE

The adoption of a sign ordinance for our coMMunities will
have a great influence on the visual esthetic value of our
new city.
We have an opportunity to create a set of regulations con-
sistent with the goals and objectives of our coMMunity plan.
The regulations for off-site signs should Meet the legiti-
Mate needs of businesses and citizens without creating a
visual blight.
There should be a reasonable systeM as to design, size
and nuMber of signs to Make Encinitas attractive to resi-
dents, visitors and coMMercial businesses.
The sign regulations and enforceMent codes should be a
set of reasonable, non-arbitrary and non-discriaitory stan-
dards and procedures which are intended to facilitate the
iMproveMent and protection of the environMent by prohibiting
the 8isuse of signing.

INTRODUCTION

In accordance with our duties as a sign coMMittee~
resolution 86-21, we have conducted a review and evaluation
of sign ordinances froM other cities~ not only in neighbor-
ing coMMunities~ but froM other Municipalities throughout
the United States that had stringent controls and regul-
tions over their signage. ,
Although most of the ordinances we studied were
structured by listing all the signs and conditions that were
allowed~ this led to an extreMely cluMbersoMe docuMent. We
decided instead to approach the structure of a ordinance by
first stating that ALL signs are illegal~ except for those
provided for.
This produces a cleaner~ More easily understood ordinance
that is Much less coMplicated then having to list every
single possibility as to size~ location~ etc.
The final ordinance will have to be written in 81egalese8
because of the legal systeM~ but we felt that for the pur-
pose of discussion and debate we should write the options in
plain English so it is written Much as a policy stateMent
which will accoMpany a legally written ordinance.
We also listed sign catagories~ such as political signs~
which will not be specifically Mentioned~ as it is required
that the ordinance be .sign nuetra18 in the legally written
regulation. However~ the coM.ittee felt that for the purpose
of discussion and debate~ we should list them.
We have presented a list of options covering off-site
signs that we feel will provide Encinitas with a sign policy
that will protect it froM the abuses of the past.
For additional background inforMation~ we have included a
rough draft of a 8kiosK8 sign prograM that is based on the
City of Carlsbad~s system.
With a new ordinance and a strong enforceMent program~ the
City of Encinitas will be able to have a Model sign prograM
that Meets the legitiMate needs of the business coMmunity
and meets the coMMunities~ aesthetic requirements.

Off-site sign regulation proposal
for the City of Encinitas

OPTION 1:
No teMporary or perManent off-site signs
allowed.
This option would not allow any sign that
advertised for a business or service that
was not located on the property on which the
sign was located. These are SOMe exaMples:
real estate developMent signs, trailer signs,
.bootleg. (illegal signs), bus bench signs,
billboards, and .open house. signs not loc-
ated on the property that is for sale.
OPTION 2: LiMited teMporary off-site signs allowed:

KIOSK SIGN PROGRAM
DEFINITION: A sMall, freestanding structure perManently afflzed to the
ground, which .ay have one or .ore surfaces used to display teMporary
real estate develop.ent advertising signs.
PURPOSE: To provide directional inforMation for potential hoMe buyers
in the Encinltas area in an attractive and safe Manner.
CONSTRUCTION:
a. The Planning Dept shall be responsible for the construction and
Maintenance of the Main kiosk structure. The Individual directional
signs shall be the responsibility of the developer. The design
criteria, size of sign, letter height, type, color, etc. shall be on
file at the Planning Dept., who shall approve each sign prior to being
placed In the kiosk structure. (See accoapanlng sheet for
111 ustrat ion. )
b. Each kiosk shall not ezceed siz feet in width and twelve feet in
height. Individual directional signs In the kiosk structure shall be
contructed so as to conforM to the size and design of the kiosk.
c. All Individual directional signs In the kiosk structure shall be
the saMe design and shall be consistent In size, width and thickness
of print. Letters shall be all 5 Inches In height. Type style shall be
approved by the Planning Dept.
d. ~ach kiosk shàll have the words .City of Enclnltas. and a logo
displayed in a pro.lnent location at the top of the kiosk. In the
event that it Is a dual-faced kiosk, then the words and logo shall
appear on both sides.
'e. The wording and logo shall consist of a gloss white painted
surface with the background sandblasted around the lettering and
stained dark brown. The support structure of the kiosk shall also be
stained dark brown consistent with the Individual directional signs.
f. There shall be no additions, streaMers, devices, display boards,
or appurtenances' added to the kiosk as originally approved. Further,
no other directional signing May be used such as posters, trailer
signs or teMporary subdlvlson directional signs.
g. Each Individual co.aunity directional sign shall contain only the
naMe of the subdivision to which, It refers, and shall contain a
directional arrow. The aaziaua nuMber of directional signs allowed in
one kiosk shall be 1 If single sided, 14 If double-faced.
h. Each kiosk shall contain space for at least one other directional
sign Indicating the location of Individual coMMunities, public
buildings, or public facilities or services so selected by the City.

a. The location of each kiosk shall be approved by the Planning Dept
prior to construction for conforMance with the kiosk location plan
approved by the City Council.
b. Kiosks May be located on private property or in the public
right-of-way. All kiosks that are to be placed on private property
shall have written consent of the property owner. Written consent
shall also include a provision perMitting the city, in the event of
non-coMpliance, Maintenance, etc.. to enter said property to reMove.
repair, repaint, etc.. A copy of said consent shall be filed with the
Planning Dept.
CONDITIONS AND ENFORCEMENT:
a. The Planning Dept. shall establish a fee schedule to be approved
by the City Council. for the developer directional sign$ that will be
placed in the kiosk structures.
b. Upon approval by the Planning Dept.. kiosk directional signs shall
be perMitted until the hoMes within the subdivision are sold or for a
period on one year. whichever COMes first. Extensions not exceeding
six Months May be granted by the Planning Dept.
c. A developMent will not be allowed any directional kiosk signs if
there are any other signs advertising that developMent anywhere in the
area covered by the City's general plan.
d. If a developMent that has approved kiosk signs erects any other
advertising signs within the city liMits of Encinitas. all kiosk signs
for that subdivision shall be reMoved. the lease cancelled. and no
refund given.
e. No developMent located outside of our city li.its shall be allowed
to use the kiosk prograM in Encinitas.
f. Any sign placed contrary to the provisions of this ordinance May
be reMoved by the City without prior notice.

Subject: Extension of a Mor"'toriuMon building perMits for
off-site developers signs.
Background: One of the priMary goals of the Encinitas Sign
CoMMittee is to create a new set of ordinances
governing off-site real estate developer signs. We
are currently studying the options open to us in
this area and will supply a draft to the City
Council after consulting with the city Manager and
the city attorney.
We are concerned however, that if the City
Council lifts the present building permit Mor1tor-
iuM, that perMits for off-site signs will be grant-
ed under our present county-adopted ordinances. We
feel this will lead to a reoccurence of the visual
blight of signs because of the county's generous
allotMent of signs coupled with their lack of en-
forceMent.
Therefore, a Motion was Maõe and passed that
states: To ask the Encinitas City Council to re-
frain froM the i.suançe of any building per.its
for off-site developer signs pending the i.~ipent
issuance of our new sign code that will replace
the presently adopted county sign ordinance.
