MINUTES OF JOINT SPECIAL MEETING OF THE CA ifFF SANITATION DISTRICT AND THE ENCINITAS CITY COUNCIL, MAY 3, 1998, 6:00 P.M, 505 SOUTH VULCAN A VENUE CALL TO ORDERIROLL CALL Because this was a joint special meeting, Board Member Aspen chaired e meeting and called the meeting to order at 7:56 P.M. Present: Board Members Lou Aspen, James Bond, Sheila Camer , John Davis, and Chuck DuVivier. Absent: None. Also Present: Board Manager Wasserman, Public Works Director Nelso , Management Analyst Orozco, Management Assistant Gallup, Deputy Board Clerk Greene, Secretary Maluia. There being a quorum present, the meeting was in order. AGENDA ITEMS Jl. Public Hearin and Introduction of Ordinance 98-09 for Ci of Encinitas ncinitas Sanita Division and Ordinance 98-01 for Cardiff Sanit tion District for Flow Based Sewer Rate Structure to Be 'n in Fiscal Year 199 /99. Contact Person: Manaeement Analyst Orozco. Management Analyst Orozco reported that the Ordinances for Agenda I ems 11, J2 and 13, were revised and contained only minor formatting changes and some minor Ian ge changes. Ms. Orozco reviewed the goals, process, considerations, rate structure, methodology, potential impacts, and schedule for adopting the flow based sewer rate s cture, stating the staff recommendation was to continue with the public hearing, and introduce th Ordinances. Mayor Aspen opened the Public Hearing. Sandy Steller spoke in opposition to the staff recommendation. Bill MacIsaac spoke in opposition to the staff recommendation and reque ted Council to consider tabling the rates for further study and to combine the Encinitas Sanitation District and the Cardiff Sanitation District into one entity. Ms. Weidner proposed that those mixed e residential meters, that have a nursery license, be charged to the median rate for a single family orne, instead of installing sub-meters. Eric Anderson, representing the San Diego County Flower and PI t Growers Association, expressed his concerns about the code not clearly addressing agricul meters that are exempt and do not have an application. Mr. Anderson stated that in the code, "a . cultural irrigation water" should be added to the definition ofIndustrial Wastewater, after the word "excluding". Gilbert Foerster addressed various concerns regarding agricultural administrative review, and sub-metering. e, application forms for Janet Kister, president of the San Diego County Flower and Plant Grow rs Association, addressed concerns regarding application forms. Ms. Kister requested that the se of sub-meters not be considered, and that simpler methods for sewer rates be used for flower gr wers. Mayor Aspen closed the Public Hearing. Public Works Director Nelson addressed various questions that were sed by the public. Mr. Nelson stated that he would look into the purchase, ownership, and inspec on of sub-meters. Board Member Du Vivier recommended that the Council not adopt th flow based sewer rate structure. Bond moved, Aspen seconded to waive further reading and to introd ce City Ordinance 98- 09 and Cardiff Sanitation District Ordinance 98-01, and instruct sta in the application of the provision for exemptions for the initial phase to imp Ie ent the agricultural recommendation stating that if a state license as a nursery is pres nted for a mixed use residential property, the residential median rate be implemented fo the initial year and during that year to continue to do research and work with the flower rowers to provide an amendment to the code to become permanent.
