RESOLUTION NO. 2001-02
RESOLUTION OF APPLICATION TO THE BOARD OF IRECTORS
OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
"TRACY ANNEXATION"
WHEREAS, this Board of Directors has received a request from r. Reid Tracy that the
hereinafter described territory be annexed to the Cardiff Sanitation Distri t (hereinafter referred
to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate proceeding to annex said territory
to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
Pursuant to Government Code Sections 56800 and 56700, applic tion is hereby made to
the Local Agency Formation Commission of the County of San iego for a proposed
change of organization as follows:

This proposal is made pursuant to the Cortese-Knox Loc Government
Reorganization Act of 1985 (S. 56000, et. seq., Govt. Co e).
The nature of the proposed change of organization and th names of all districts
for which any such change of organization is proposed ar as follows: The
annexation of the hereinafter described territory to the C diff Sanitation District.

The names of all other affected counties, cities and distri ts are: City of Encinitas.
D.
A description of the exterior boundaries of the territory p oposed to be annexed to
the Sanitation District is described in "Attachment 2" h reto attached.
E.
Said territory is uninhabited and comprises approximate 2.50 acres.
F.
It is proposed that said territory be annexed subject to th following condition:
Payment of District processing, Local Agency Formatio Commission processing,
and State Board fees.
G.
All the owners of land within such territory have given eir written consent to
such annexation subject to the aforementioned terms an conditions.
H.
The reasons for this proposal are as follows:

The Sanitation District is empowered to and is eng ed in furnishing
sewage disposal facilities.
The territory proposed to be annexed to said Distric is developed and/or
proposed to be developed and used for residential a dlor commercial

essential for such purposes.

It is hereby requested that proceedings be taken for the ann xation of territory as
herein above proposed.

This annexation is consistent with the sphere of influence
District.
The Board finds that the annexation is categorically exe pt from environmental
review in accordance with CEQA Class 19, Section 1531 (b) and Section
15303(a).
K.
The Clerk of the Board of Directors is hereby authorized and dire ted to file a certified
copy of this resolution with the Executive Officer of the Local A ency Formation
Commission of the County of San Diego.
