1989-18 RESOLUTION NO.C-89-018 A RESOLUTION OF THE CARDIFF-BY-THE-SEA COIOlUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERKIT FOR THB CONSTRUCTION OF A DUPLBX RESIDENTIAL STRUCTURE LOCATBD AT 1613 SAN BLIJO AVENUB (CASB NO.: 89-120 DR) WHEREAS, a request for consideration of a Design Review Application was filed by Jay Johnston and Chris Alley to allow the construction of a duplex residential dwelling, as per Chapter 23.08 of the City of Encinitas Municipal/Zoning Codes, for the property located at 1613 San Elijo Avenue, legally described as; Lots "E" and "F" in Block 77 of Cardiff Villa Tract, in the City of Encinitas, County of San Diego, State of California, according to Map thereof No. 1469, filed August 10, 1912, in the Office of the County Recorder of said San Diego County. WHEREAS, a public hearing was conducted on the application on July 10,1989, and all persons desiring to be heard were heard; and WHEREAS, evidence was submitted and considered to include without limitation: 1. The staff report dated July 5, 1989; 2. The adopted General Plan, Zoning Code and Associate Land Use maps; 3. Oral evidence submitted at the hearing; 4. Written evidence submitted at the hearing; 5. Documentation and site plans submitted by the applicant; and WHEREAS, the Cardiff-by-the-Sea Community Advisory Board made the required findings pursuant to Section 23.08 of the Zoning Code; CO/02/cAB18-1366WP5/(7-20-89/1) (See Attachment "A") NOW, THEREFORE, BE IT RESOLVED by the Cardiff-by-the-Sea Community Advisory Board of the City of Encinitas that the Design Review Application is hereby approved subject to the following conditions: (1) The project as submitted is approved and shall not be altered without City approval. (2) All structural improvements shall maintain the setback requirements prescribed by the current zoning code for the subject property. (3) The owner(s) shall submit proof of Coastal commission approval prior to issuance of a Building Permit. (4) A licensed surveyor shall verify the height of the structure at the time of framing inspection to certify that the height shall conform to approved plans. (5) Plantings for landscaping shall conform to the landscape plan reviewed and approved by the Community Advisory Board. Any landscaping to be placed within the street right-of-way shall first be approyed (in writing) by the Department of Public Works. (6) No obstructions shall be permitted within the public right-of-way to the satisfaction of the Public Works Department. (7) The developer shall execute and record a covenant for the benefit of the City with the County Recorder agreeing not to oppose the formation of an assessment district to fund the installation of right-of-way improvements. (8) Block screening walls, of stucco-coated or decorative block material,. shall be constructed along the front property line the length of each "turn-around" area. Said walls shall measure between 36 to 42 inches in height. (9) If required by the Department of Public Works, a grading plan, in accordance with the City's Grading Ordinance, shall be submitted to, and approved by, the Public Works Department prior to the issuance of a Building Permit. A soils/geological/hydraulic report (as applicable) shall be prepared by a qualified Engineer and submitted to the CO/02/cAB18-1366WP5/(7-20-89/1) Public Works Department at first submittal of a Grading Plan. (10) If required by the Department of Public Works, a drainage system plan for handling and disposing of surface water originating within the project shall be submitted to, and approved by, the Department of Public Works. Concentrated flows across driveways and/or sidewalks shall not be permitted. (11) Fire sprinkler systems for the dwelling units and garages shall be installed per NFPA 13 D and Encinitas Fire Ordinance specifications. The applicant shall provide written proof that all development impact, plan check, and/or cost recovery fees have been paid prior to building permit issuance to the satisfaction of the Fire Preyention District. (12) Prior to building permit issuance or final occupancy approval, as determined by the concerned agency, all school impact, traffic impact, drainage, and/or park fees shall be paid. (13) A covenant limiting the height of landscaping for preservation of view shall be recorded, to the satisfaction of the Planning and Community Development Department, prior to final occupancy. (14) An automated irrigation system shall be installed to provide water to all planting material. (15) The owner(s) shall prepare, and cause to be recorded with the County Clerk, a certificate of Compliance which shall merge the two lots into a single lot of record. In lieu thereof, the owner(s) shall provide proof to the satisfaction of the Director of Community Development that lots "E" and "F" have been legally merged. (16) Other standard requirements for engineering, building, and fire code approval shall be satisfied by the project developer. BE IT FURTHER RESOLVED by the Cardiff-by-the-Sea Community Advisory Board of the City of Encinitas that: (1) This project was found to be exempt from Environmental Review, section 15303; Class 3(a) of CEQA.
