BOARD OF DIRECTORS
APPROVING AN ANNEXATION APPLICATION QUEST
FOR A 10.06 ACRE PROPERTY
LOCATED IN THE SPHERE OF INFLUE CE
OF THE CARDIFF SANITATIONDISTRI T
APPROXIMATEL Y380 FEET EAST
OF THE TERMINUS OF LONE HILLS ESTATE COURT

WHEREAS, a request for consideration of an Annexation A plication Request into the
Cardiff Sanitation District was filed by Gary Bukamier / Pasco Eng eering for the hereinafter
described territory in accordance with the Cortese-Knox Local Gove ent Reorganization Act of
1985 (Govt. Code Sec. 56000 et. seq.), for property located approxi ately 380 feet east of the
terminus of Lone Hills Estates Court, legally described as:
PARCEL 1 OF PARCEL MAP 4645, FILED APRIL 16, 1976, IN THE OFFICE OF THE
COUNTY RECORDER OF SAN DIEGO COUNTY, BEIN ALSO A PORTION OF
THE SOUTHEAST QUARTER OF THE SOUTHWEST Q ARTER OF ,SECTION 4,
TOWNSHIP 13 SOUTH, RANGE 3 WEST, SAN BE ARDINO BASE AND
MERIDIAN, IN THE COUNTY OF SAN DIEGO, ST TE OF CALIFORNIA,
ACCORDING TO UNITED STATES SURVEY, APPROVE NOVEMBER 19, 1880;
AND MORE PARTICULARL YDESCRIBED IN THE G T DEED RECORDED AS
FILE NO. 76-246431, IN THE OFFICE OF THE COUN Y RECORDER OF SAN
DIEGO COUNTY ON AUGUST 3, 1976; and
WHEREAs, the Board of Directors desires to initiate procee ings to annex said territory
into the Cardiff Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code Section 56700 and 56800, appli ation is hereby made to the
Local Agency Formation Commission of the County of San Diego for a proposed change of
organization as follows:
A.
This proposal is made pursuant to the Cortese- ox Local Government
ReorganizationAct of 1985 (Govt. Code Sec. 56000 et.s q.).
B:
The nature of the proposed change of organization and e name of all districts for
which the change of organization is proposed is as foll ws: The annexation of the

above described territory to the City of Encinitas and annexation to the Cardiff
Sanitation District pursuant to Resolution No. 98-08 of e Board of Directors of the
Cardiff Sanitation District.
The names of all other affected counties, cities and dis . cts are: the County of San
Diego, the City of Encinitas, the Cardiff Sanitation D'strict, and County Service
Area No. 83 (San Dieguito Local Parks).

A description of the exterior boundaries of the territory proposed to be annexed to
the City of Encinitas is described above.
E.
Said territory is uninhabited and comprises approximatel 10.06 acres.
F.
It is proposed that the territory be annexed subject to the ollowing conditions:
(1) Payment of Cardiff Sanitation District exation fees, payment of
LAFCO annexation processing fees, and pa ent of State Board of
Equalization fees.
(2) Prior to development of the above descri d property, the property
owners shall comply with all City of Encini and Cardiff Sanitation
District standards and Code requirements for pro rty development.
G.
All owners of land within said territory have given th ir written consent to such
annexation subject to the aforementioned terms and con .tions.
H.
The reasons for the annexation proposal are as follows:
(1) The Cardiff Sanitation District is empo ered and is engaged in
furnishing sewage disposal services and faciliti s and has determined that
the District is prepared to provide said service n accordance with District
standards and requirements to the territory descri ed above.

(2) The territory proposed to be annexed to the Cardiff Sanitation is
proposed to be developed at some future dat and used for residential
purposes and the provision for sewage disposal cilities is essential for said
future purpose.

It is hereby directed that proceedings be taken for e annexation of territory
pursuantto Section 56700 (et.seq.) of the Govt. Code, as hereinabove proposed.
J.
This annexation is consistent with the Sphere ofInfluenc of the Sanitation District.

Pursuant to the State of California Environmental Quality Act ( EQA) Guidelines Section
15074, the Board finds that there is no substantial evidence that the annexation will have a

significant adverse effect on the environment and thus adopts a Mitigated Negative
Declaration for this project as recommended by the Environmental Initial Assessment
(EIA).
3.
The Clerk of the Board of Directors is hereby authorized and directed to file a certified copy
of this Resolution with the Executive Officer of the Local Agency Formation Commission
of the County of San Diego.
