RESOLUTION NO. C-89-~
A RESOLUTION OF THE CARDIFF-BY-THE-SEA
COMMUNITY ADVISORY BOARD, CITY OF ENCINITAS
DENYING A DESIGN REVIEW PERMIT MODIFICATION TO
RAISE THE HEIGHT FOR A PROPOSED SINGLE FAMILY
RESIDENCE AT 329 KILKENNY DRIVE.
(CASE NO. 89-039-DRM)
WHEREAS,
a request for consideration of a Design Review
modification was filed by Jerry Wilson to allow an increase in
height and exterior design modifications to a previously approved
single family residence in accordance with Chapter 23.08 of the
City of Encinitas Zoning Code, for property located at 329 Kilkenny
Drive, legally described as:
Lot 1 in Block "D" of Cardiff, in the City of Encinitas,
County of San Diego, State of california, according to Map No.
1298, filed in the office of the County Recorder of San Diego
County, November 14, 1910.
WHEREAS, A Public Hearing was conducted on the application on
March 27, 1989; and
WHEREAS, The Community Advisory Board considered:
1.
The staff report dated March 22, 1989;
2.
The proposed General Plan, Local Coastal Program, Zoning
Code and maps;
3.
Oral evidence submitted at the hearing; and
4.
Written evidence submitted at the hearing; and

WHEREAS, the Cardiff-by-the-Sea Community Advisory Board made
the following findings pursuant to Ordinance 87-80 and section
23.08 of the Municipal Code:
(1)
The requested modification to increase the structural
height approximately six (6) feet beyond the formerly
approved height will impact views of adjacent properties
and would create a significant negative view impact from
the Interstate 5 freeway due to the prominent bluff
location of the subject property.
The additional structural size (bulk and mass) would
create a fully exposed 3-story structure which is found
to be incompatible in structural size to adjacent
properties and the neighborhood.

The proposed modification would raise the building height
to 35 feet which would conflict with the anticipated
General Plan height limit of 30 feet (Policy 7.10 of the
Land Use Element; Dec. Draft).

BE IT RESOLVED by the Cardiff-by-the-Sea
THEREFORE,
Community Advisory Board of the City of Encinitas that the Design
Review modification is hereby denied.
