RESOLUTION OF APPLICATION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
"Mr. Bruce Wiegand"
WHEREAS, this Board of Directors has received a request from Mr. Bruce Wiegand that
the hereinafter described territory to be annexed to the Cardiff Sanitation District (hereinafter
referred to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate proceedings to annex said territory
to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1.
Pursuant to Government Code Sections 56800 and 56700, application is hereby made to
the Local Agency Formation Commission of the County of San Diego for a proposed
change of organization as follows:
A.
This proposal is made pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (S. 56000, et. seq., Govt. Code).
B.
The nature of the proposed change of organization and the names of all districts
for which any such change of organization is proposed as follows: The
annexation of the hereinafter described territory to the Cardiff Sanitation District.
C.
The names of all other affected counties, cities and districts are: City ofEncinitas.
D.
A description of the exterior boundaries of the territory proposed to be annexed to
the Sanitation District is described in Exhibit "A" hereto attached.
E.
Said territory is uninhabited and comprises approximately .5 acres.
F.
It is proposed that said territory be annexed subject to the following condition:
Payment of District annexation and State Board fees.
G.
All the owners of land within such territory have given their written consent to
such annexation subject to the aforementioned terms and conditions.
H.
The reasons for this proposal are as follows:

(1)
The Sanitation District is empowered to and is engaged in furnishing
sewage disposal facilities.
(2)
The territory proposed to be annexed to said District is developed and/or
proposed to be developed and used for residential and/or commercial
purposes and provision for sewerage disposal facilities for said territory is
essential for such purposes.
I.
It is hereby requested that proceedings be taken for the annexation of territory as
herein above proposed.
J.
This annexation is consistent with the sphere of influence of the Sanitation
District.
2.
Pursuant to the State California Environmental Quality Act Guidelines, section 15319
(California Environmental Quality Control Act of 1970) that this annexation is
categorically exempt (Class 19) from further environmental review.
3.
The Clerk of the Board of Directors is hereby authorized and directed to file a certified
copy of this resolution with the Executive Officer of the Local Agency Formation
Commission of the County of San Diego.

CAMPAIGN CONTRIBUTION DISCLOSURE PROVISIONS!
PARTY DISCLOSURE FORM
LAFCOs are subject to the campaign disclosure provisions detailed in Government Code
Section 84308, and the Regulations of the Fair Political Practices Commission (FPPC),
Section 18438. Please carefully read the following information to determine
whether the provisions apply to you. If you determine that the provisions are
applicable, the attached form must be completed and returned with your proposal
application.
1. No LAFCO commissioner shall accept, solicit, or direct a contribution of more than
$250 from any party, or agent, while a change of organization proceeding is pending,
and for three months subsequent to the date a final decision is rendered by LAFCO.
This prohibition commences when your application has been fited, or the proceeding is
otherwise initiated.

"Party" is defined as any person who files an application for, or is the subject of,
a proceeding.
"Agent" is defined as a person who represents a party in connection with a
proceeding. If an individual acting as an agent also is acting as an employee or member
of a law, architectural, engineering, or consulting firm, or a similar entity or corporation,
both the individual and the entity or corporation are agents. When a closed corporation
is a party to a proceeding, the majority shareholder is subject to these provisions.
2. A party to a LAFCO proceeding shall disclose on the record of the proceeding any
contribution of more than $250 made to any commissioner by the party, or agent, during
the preceding 12 months. No party to a LAFCO proceeding, or agent, shall make a
contribution to a commissioner during the proceeding and for three months following the
date a final decision is rendered by LAFCO.

3. Prior to rendering a decision on a proceeding, any ~ommissioner who received
contribution of more than $250 within the preceding 12 months from any party, or agent,
to a proceeding shall disclose that fact on the record of the proceeding,. and shall be
disqualified from participating in the proceeding. However, if any commissioner receives
a contribution that otherwise would require disqualification, and returns the contribution
within 30 days of knowing about the contribution and the relevant proceeding, that
commissioner shall be permitted to participate in the proceeding.
