RESOLUTION NO. C-88-030
A RESOLUTION OF THE CARDIFF-BY-THE-SEA
COMMUNITY ADVISORY BOARD APPROVING A
DESIGN REVIEW PERMIT FOR PROPERTY OF LOTS 37
BLOCK 6, CARDIFF, MAP 1369,
COUNTY OF SAN DIEGO
(COMMONLY KNOWN AS 2445 SAN ELIJO AVENUE)
& 38,
WHEREAS, Jim and Richard Huntington applied for a Design
Review permit
for the conversion of a duplex to a single
family use with associated addition and remodel on two lots as
per
the City of Encinitas City Council Ordinance 88-19 and
section 23.08 Design Review of the City Zoning Ordinance; and
WHEREAS, a public hearing was conducted on the application
by the Cardiff-by-the-Sea Community Advisory Board
on August
8, 1988 and all persons desiring to be heard were heard; and
WHEREAS, evidence was submitted and considered to include
without limitation:
a.
site plan submitted by the applicant;
written information submitted with the application;
Oral testimony from staff, applicant, and public made
a part of the record at said public hearing;
CAB staff report (88-167-DR) dated August 2, 1988
which is on file in the Department of Planning and
Community Development; and
Additional written documentation.

The project design does preserve significant public views
to the extent possible, and offers mitigation for lost
views, since none of the proposed building walls project
further into the side yard setbacks further than any
existing building walls, and the proposed second story
addition does not impact any westward views due to its
orientation behind the existing structure. Public views
are defined as those views provided from public property.

The project takes advantage of views and/or protects to
the extent possible, some of the significant view enjoyed
by the residents of nearby properties, since the project
being proposed enjoys an unobstructed westward view, and
the project as proposed will not result in a significant
increase in building mass since the proposed second story
addi tion is proposed to be approximately 16' X 16', and
the first floor structure walls will not project any
further into the side yard setbacks than do any of the
existing building walls.
That the proposed project is in conformance with section
23.08.72 of the Design Review Ordinance, since the project
is in consistent with the existing and proposed General
Plan in land use by converting an existing duplex use into
a single family home.

That the proposed project is in conformance with section
23.08.74 of the Design Review Ordinance, since the project
is a general upgrade of an existing structure.

That the proposed project is in conformance with section
23.08.764 the Design Review Ordinance, since the exterior
materials for the project have been coordinated
throughout the site, and the proposed modified structure
will be compatible site and bulk with the neighborhood.
NOW THEREFORE, BE IT RESOLVED by the Cardiff-By-The-Sea
Community Advisory Board of the City of Encinitas that the
Design Review permit for the conversion of a duplex to a single
family use with associated addition and remodel on two lots is
hereby approved subject to the following findings:
BE IT ALSO RESOLVED,
that the Design Review Permit is
approved
with the following conditions:
A.
The project is approved as submitted and shall not be
altered without Community Advisory Board review and
approval.
B.
The lots shall be merged prior to final inspection
through the certificate of compliance process.

C.
Applicant to sign and record a covenant agreeing not
to protest any proceedings for the installation or
acquisition of public improvements under any
applicable special assessment proceedings.
D.
The owner(s) shall sign and record a covenant
agreeing to maintain the height of landscaping not to
exceed the building's height.
