RESOLUTION NO. C-88-028A
A RESOLUTION OF THE CARDIFF-BY-THE-SEA
COMMUNITY ADVISORY BOARD APPROVING A
DESIGN REVIEW PERMIT FOR PROPERTY OF LOT 330
POINSETTIA HEIGHTS UNIT NO.7, MAP 5089
COUNTY OF SAN DIEGO
(COMMONLY KNOWN AS 1974 FREDA LANE)
WHEREAS, Lawrence Rhyne applied for a Design Review permit
for an addition to an existing single family dwelling unit on
one lot as per
the City of Encinitas city Council Ordinance
87-80;
WHEREAS, public hearings were conducted on the application
by the Cardiff-by-the-Sea Community Advisory Board
on June 27,
and August 22, 1988 and all persons desiring to be heard were
heard; and
WHEREAS, evidence was submitted and considered to include
without limitation:
a.
site plan submitted by the applicant;
written information submitted with the application;
Oral testimony from staff, applicant, and public made
a part of the record at said public hearing;
CAB staff reports (88-141-DR) dated June 27, and
August 16, 1988 which is on file in the Department of
Planning and Community Development; and
Additional written documentation.

NOW THEREFORE, BE IT RESOLVED by the Cardiff-by-the-Sea
Community Advisory Board of the City of Encinitas that the
Design
Review permit an addition to a single family dwelling
unit on one lot is hereby approved subject to the following
findings:

That the project does not project out of the interim
envelope and does not significantly impact the views
of adj acent properties, in that the proj ect takes
advantage of views while maintaining some of the
significant views enjoyed by residents of nearby
properties, since only one portion of the structure
is proposed to be increased to two stories and
considerable vegetation exists in front of the
proposed second story addition;
That the proj ect is compatible in structural size
(bulk and mass) to adjacent properties and
neighborhood, since other single family homes in the
neighborhood have two stories.
BE IT ALSO RESOLVED,
that the Design Review Permit is
approved

with the following conditions:
The project is approved as submitted and shall not be
altered without Community Advisory Board review and
approval.
Prior to the City Building Department issuing a
final inspection on framing, the applicant shall
provide a survey from a civil engineer as to the
building height.
