1988-26A 8 . 8 RESOLUTION NO. C-88-026A A RESOLUTION OF THE CARDIFF-BY-THE-SEA COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT FOR PROPERTY OF LOTS 37 BLOCK 24, CARDIFF, MAP 1298, COUNTY OF SAN DIEGO (COMMONLY KNOWN AS 2243 OXFORD AVENUE) & 38, WHEREAS, Nancy Macy applied for a Design Review permit for the addition of a front deck and stairway to an existing single family dwelling unit on two lots as per the City of Encinitas City Council Ordinance 88-19 and Section 23.08 Design Review of the City Zoning ordinance; and WHEREAS, a public hearing was conducted on the application by the Cardiff-by-the-Sea Community Advisory Board on August 8, 1988 and all persons desiring to be heard were heard; and WHEREAS, evidence was submitted and considered to include without limitation: a. site plan submitted by the applicant; written information submitted with the application; Oral testimony from staff, applicant, and public made a part of the record at said public hearing; CAB staff report (88-206-DR) dated August 3, 1988 which is on file in the Department of Planning and Community Development; and Additional written documentation. b. c. d. e. NOW THEREFORE, BE IT RESOLVED by the Cardiff-by-the-Sea Community Advisory Board of the City of Encinitas that the Design Review permit for the addition of a front deck and stairway to a single family dwelling unit on two lots is hereby approved subject to the following findings: LN/ln/CAB11b-904wp (8-3-88) 8 8 BE approved A. B. 8 1. The project design does preserve significant public views to the extent possible, and offers mitigation for lost views, since the deck addition will not exceed the present building envelope in height or side yard setbacks and the encroachment of 3' into the interim 20' front yard setback is one story in nature with open railing on the deck rather than solid. Public views are defined as those views provided from public property; 2. The project takes advantage of views and/or protects, to the extent possible, some of the significant view enjoyed by the residents of nearby properties, since the proj ect is being proposed to allow outdoor viewing of the ocean to the west and is not proposed to exceed the existing dwelling envelope in height or sideyard setbackis. 3. That the proposed project is in conformance with Section 23.08.72 of the Design Review Ordinance, since the project is consistent with the existing and proposed General Plan in land use allowing single family dwelling units; 4. That the proposed proj ect is in conformance with Section 23.08.74 of the Design Review Ordinance, since the project was designed to be of minimal impact not to exceed one story with open railing; 5. That the proposed project is in conformance with Section 23.08.76 of the Design Review Ordinance, since the exterior materials for the project have been coordinated to be compatible with the structure and the entire structure will be repainted in navajo white with light blue trim, and the structure will still be of compatible size and bulk with the neighborhood; IT ALSO RESOLVED, that the Design Review Permit is with the following conditions: The project is approved as submitted and shall not be altered without Community Advisory Board review and approval. The lots shall be merged prior to final inspection through the certificate of compliance process.
