RESOLUTION NO. C-88-026
A RESOLUTION OF THE CARDIFF-BY-THE-SEA
COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW
PERMIT (88-147-DR) FOR A COMMERCIAL OFFICE BUILDING
FOR PROPERTY OF LOTS. 25 TO 30 INCLUSIVE, BLOCK 30,
CARDIFF, MAP 1298, COUNTY OF SAN DIEGO
(COMMONLY KNOWN AS 2187 NEWCASTLE AVENUE)
WHEREAS, craig Lewis, applied for a Design
Review permit
for a commercial office building for property of Lots 25 to 30
inclusive, in block 30, Cardiff-By-The-Sea, Map 1298, County of
San Diego, as required by section 23.08 Design Review of the
City of Encinitas zoning Ordinance; and
WHEREAS, public hearings were conducted on the application
by the Cardiff community Advisory Board
on July 11 and August
8, 1988, and all persons desiring to be heard were heard; and
WHEREAS, evidence was submitted and considered to include
without limitation:
a.
site plan submitted by the applicant;
written information submitted with the application;
Oral testimony from staff, applicant, and public made
a part of the record at said public hearing;
CAB staff reports (88-147-DR) dated July 5, and
August 3, 1988 which are on file in the office of
Planning and Community Development; and
Additional written documentation.

NOW THEREFORE,
BE IT RESOLVED by the Cardiff Çommunity
Advisory Board of the City of Encinitas that the Design
Review
permit for 88-147-DR for a commercial office building at 2187
Newcastle Avenue is hereby approved subject to the following
findings:

That the proposed project is in conformance with
section 23.08.72 of the Design Review Ordinance,
since the project is consistent with the existing and
proposed General Plan in land use allowing commercial
development of this type in the C-36 zone;
That the proposed project is in conformance with
section 23.08.74' of the Design Review Ordinance,
since the project was designed to preserve or
relocate some of the existing mature trees on the
site and the project as designed protects public
views to the extent possible on a less than 10%
sloped lot since the maximum height allowed in the
zoning has not been proposed;

That the proposed project is in conformance with
section 23.08.76 of the Design Review Ordinance,
since the exterior materials for the proj ect have
been coordinated to be compatible with each other and
the surrounding area, and the proposed structure is
compatible with the size and scale of other
commercial structures in the surrounding
neighborhood; and
6.
That the proposed project is in conformance with
section 23.08.77 of the Design Review Ordinance,
since the project is proposing extensive landscaping
and will be retaining as many of the existing mature
trees as possible.
BE IT ALSO RESOLVED,
that the Design Review Permit is
with the following conditions:
A.
The proj ect is approved and shall not be altered
without Community Advisory Board review and approval.
B.
Prior to the city Building Department issuing a
final inspection on framing, the applicant shall
provide to the Department of Planning and Community
Development a survey from a civil Engineer as to the
building height in conformance with this Design
Review approval.
C.
That the lots be merged through the certificate of
compliance process prior to final occupancy of the
structure.

That the property owner pave the
satisfaction of the City Engineer.

That the project be constructed with an automatic
fire sprinkler system and fire sprinkler alarm system
to the satisfaction of the Encinitas Fire Protection
District.
That the property owner remove the existing curb on
Chesterfield and construct "G" curb and gutter.

That a 5' concrete sidewalk adjacent to the curb be
constructed on Newcastle and Chesterfield.
That a wheelchair ramp be constructed at Chesterfiled
and Newcastle.

That concrete drive approaches be constructed as per
regional standards.
L.
That an asphalt swale on the east side of Newcastle
at gutterline be constructed to retain water to
existing curb and gutter.
M.
That 1" asphalt overlay be provided on Newcastle to
centerline to the satisfaction of the City Engineer.
N.
That the alley be repaired adjacent to the subject
property with asphalt patching as required.

That a grading plan be submitted prior to issuance of
building permits.
P.
That an irrevocable offer of dedication shall be made
for 10' along chesterfield adjacent to the property
for road purposes, and that an irrevocable offer of
dedication shall be made for 5' along Newcastle
adjacent to the subject property for road purposes.
Q.
That a drainage study addressing surface water flows
and the impact, if any, on adjacent properties be
submitted prior to issuance of building permits.
That the property owner sign and record a covenant
agreeing not to protest any proceedings for the
installation or acquisition of public improvements

under any applicable special assessment district.

Walls constructed on property lines are required to
be one hour rated without openings with a parapet
extending 30" above the roofline.

provisions shall be made for access to the building
by the physically disabled.

A complete building code review will be conducted
upon submittal of construction drawings at the plan
check stage.
v.
A covenant shall be recorded requiring that the
landscaping be planted and maintained at a height no
greater than the height of the building as approved
on the landscape plan dated April 26, 1988 on file in
the Department of Planning and Community Development
prior to approval for final occupancy.
W.
That the sign program be referred to staff with the
concerns for design and treatment discussed at the
public hearing made a part of the record.
