RESOLUTION NO. C-88-007
A RESOLUTION OF THE CARDIFF-BY-THE-SEA
COMMUNITY ADVISORY BOARD APPROVING A
DESIGN REVIEW PERMIT FOR PROPERTY OF THE SOUTHERLY 5 FEET
OF LOT 11 AND ALL OF THOSE PORTIONS OF LOTS 12 THROUGH 19
INCLUSIVE IN BLOCK 3, CARDIFF, MAP 1298, COUNTY OF SAN DIEGO
(COMMONLY KNOWN AS 2554 AND 2556 MANCHESTER AVENUE, CARDIFF)
WHEREAS, Les Burge applied for a Design Review permit
for
drainage, landscaping, and design modifications to the exterior
chimney and window treatments for a duplex on one lot as per
Chapter 23.08 Design Review, of the City of Encini tas Zoning
Ordinance;
WHEREAS, a public hearing was conducted on the application
by the Cardiff-by-the-Sea Community Advisory Board
on March
28, 1988, and all persons desiring to be heard were heard; and
WHEREAS, evidence was submitted and considered to include
without limitation:

Site plan submitted by the applicant;
Written information submitted with the application;
Oral testimony from staff, applicant, and public made
a part of the record at said public hearing;
CAB staff report (87-106-DR) dated March 24, 1988
which is on file in the Department of Planning and
Community Development; and
Additional written documentation.

NOW THEREFORE, BE IT RESOLVED by the Cardiff-by-the-Sea
Community Advisory Board of the City of Encinitas that the
Design
Review is hereby approved subject to the following
findings:

1.
That the proposed proj ect is in conformance with
the intent of Section 23.08.72 of the Design Review
Ordinance, since the project is consistent with
subsections A through D;
2.
That the proposed project is in conformance with the
intent of Section 23.0S.74 of the Design Review
Ordinance, since the project is consistent with
subsections A through J;
3.
That the proposed project is in conformance with the
intent of Section 23.08.76 of the Design Review
Ordinance, since the project is consistent with
subsections A through G;
4.
That the proposed project is in conformance with the
intent of Section 23.08.77 of the Design Review
Ordinance, since the project is consistent with
subsections A through D;
BE IT ALSO RESOLVED,
that the Design Review Permit is
with the following conditions:
The project is approved as submitted and shall not be
altered without Community Advisory Board review and
approval.
A covenant shall be recorded in the County Recorder's
office agreeing to plant and maintain the landscaping
approved on the revised landscape plan, requiring in
part that all trees be maintained at a height not to
exceed the building height directly adjacent to the
subject tree, and that at all times drainage
eminating from the site be controlled so as not to
dump silt or high volumes of water across the public
right of way.
That the curb be continued to the south end of the
unimproved land area with the curb tapering down to
San Elijo and wrapping around the corner.
That the applicant return to staff for approval of a
landscape plan showing heights of planting at sill
height of the lower level of the building and
covering the lower story where there are no windows.
