C-88-002 A RESOLUTION OF THE CARDIFF-BY-THE-SEA COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT FOR THE LANDSCAPING AND DRAINAGE PLAN FOR FOUR ZERO LOT LINE SINGLE FAMILY DWELLINGS FOR PROPERTY OF LOTS 9, 10, 11 AND 12 IN BLOCK 11 OF CARDIFF, COUNTY OF SAN DIEGO, MAP 1298, CITY OF ENCINITAS WHEREAS, william Sandeman applied for a Design Review permit for the landscaping and drainage plan for 4 zero lot line single family dwellings four lots Chapter 23.08 Design on as per Review, of the City of Encinitas zoning Ordinance; WHEREAS, a public hearing was conducted on the application by the Cardiff-by-the-Sea Community Advisory Board on Februry 8, 1988, and all persons desiring to be heard were heard; and WHEREAS, evidence was submitted and considered to include without limitation: a. site plan submitted by the applicant; written information submitted with the application; Oral testimony from staff, applicant, and public made a part of the record at said public hearing; CAB staff report (87-067-DR) dated February 8, 1988, which is incorporated by this reference as though fully setforth herein; and Additional written documentation. b. c. d. e. NOW THEREFORE, BE IT RESOLVED by the Cardiff-by-the-Sea Community Advisory Board of the City of Encinitas that the Design Review permit for the landscaping and drainage plan is hereby approved subject to the following finding: 1. That the proposed project is in conformance with the intent of section 23.08.77 of the Design Review Ordinance, since the project is consistent with subsections A through D. ' BE IT ALSO RESOLVED that the Design Review permit is approved subject to the following conditions: 1) That a plan be submitted for approval by t~e Director of Planning and community Development and the Encinitas Fire protection District regarding the treatment of the site during the construction phase, and the circulation and parking of construction workers' vEhicles and any heavy equipment needed for the construction of the project. That a waiver of liability and indemnification clause in reference to subsidence on the bluff be recorded in a covenant to run with the land releasing the city of Encinitas from liability. 3) That a covenant be recorded to maintain landscaping for larger PASSED AND ADOPTED this 8th day of February, 1988, Þy no higher than following vote, to wit: 2) the:s to be the building height.
