1987-18 8 e 8 RESOLUTION NO. C-87-018 A RESOLUTION OF THE CARDIFF-BY-THE-SEA COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT FOR PROPERTY LOCATED AT 2384 MANCHESTER AVENUE, CARDIFF-BY-THE-SEA WHEREAS, Geof Beldon applied for a Design review permit required by City of Encinitas Design Review Ordinance 23.08, and City Council Ordinance 87-68; WHEREAS, the Cardiff-by-the-Sea CAB held a public hearing on September 30, 1987, as required by law, and all persons desiring to be heard were heard; and WHEREAS, evidence was submitted and considered to include without limitation: 1. Site plan and elevations submitted by the applicant; 2. Written information submitted with the application; 3. Oral testimony from Staff, applicant, and public made a part of the record at said public hearing; 4. CAB staff report 87-017-DR dated September 30, 19871 which is incorporated by this reference at though fully set forth herein; and 5. Additional written documentation. NOW THEREFORE, BE IT RESOLVED by the Cardiff-by-the-Sea Community Advisory Board of the City of Encinitas that the Design Review permit for 2384 Manchester Avenue, Cardiff-by-the-Sea is hereby approved subject to the following findings in accordance with Ordinance 87-68: 1. The project design preserves significant public views to the extent possible, and it offers mitigation for lost views. Public views are defined as those views provided from public property. 2. The project takes advantage of views and/or protects to the extent possible, some of the significant view LN/jc/CAB4-236 (9-28-87) 8 8 8 made: 2. 3. 4. 5. enjoyed by the residents of nearby properties. 3. The proj ection out of the interim envelope does not significantly impact the view of adj acent properties, in that the project takes advantage of views while maintaining some of the significant views enj oyed by residents of nearby properties. 4. The project is compatible in structural size (bulk and mass) to adjacent properties and neighborhood. 5. There is reasonable probability that the land use and design proposed will be consistent with the General Plan proposal being considered or studied. 6. There is little or no probability of substantial detriment to or interference with the future adopted General Plan if the proposed design is ultimately inconsistent with the plan. 7. The proposed design complies with all other applicable requirements of state law and local ordinances. BE IT ALSO RESOLVED that the following standard findings are 1.
