RESOLUTION NO.C-87-0l7
A RESOLUTION OF THE CARDIFF-BY-THE-SEA
COMMUNITY ADVISORY BOARD OF
THE CITY OF ENCINITAS APPROVING A BOUNDARY ADJUSTMENT
FOR PROPERTY OF LOTS 1 AND 2, IN BLOCK D, MAP 1298, CARDIFF, CA
WHEREAS,
a request for a Boundary Adj ustment has been
submitted by Jerry Wilson as required by the Government Code, and
Chapter 24.70 of the City of Encinitas Subdivision Ordinance;
WHEREAS, the Boundary Adjustment 87-063-BA is in conformance
with the State Subdivision Map Act and the City of Encinitas
Subdivision Ordinance;
WHEREAS, a public hearing was conducted on the application
on September 30, 1987, and those persons desiring to
be heard
were heard; and
WHEREAS,
evidence was submitted and considered to include
without limitation:
A.
Application 87-063-BA;
B.
Written information submitted with the application;
C.
Oral testimony from staff, applicant, and public made a
part of the record at said public hearing; and
D.
Staff report (87-063-BA) dated September 30, 1987,
which is incorporated by this reference as though fully
set forth herein.
NOW THEREFORE,
BE IT RESOLVED that the Cardiff-By-The-Sea
CAB of the City of Encinitas hereby approves the Boundary
Adjustment for property of Lots 1 and 2, in Block D, Map 1298,
Cardiff,
California, and that the approval is based on the
following findings:

The Boundary Adjustment will not create a condition which
does not comply with City of Encinitas Zoning regulations;
The Boundary Adjustment will not create a condition which
does not comply with building regulations;
The Boundary Adjustment will not materially, adversely
affect an agreement for the security for the construction of
public improvements;
The Boundary Adjustment does not
limit boundary;
extend beyond the
City
The Boundary Adjustment does not require substantial
alteration of any existing improvement or create a need for
any new improvements; and
The Boundary Adjustment will not adjust the boundary line
between lots which are subject to an agreement for public
improvements, unless the City Engineer finds that the
proposed adjustment will not materially affect such
agreement for the security therefore.
PASSED AND ADOPTED this 30th day of September, 1987, by the
