RESOLUTION NO. 95-07
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
CARDIFF SANITATION DISTRICT AUTHORIZING THE
NON-COMPETITIVE NEGOTIA TION OF A
CONSTRUCTION CONTRACT WITH INSITUFORM
SOUTHWEST TO REHABILITATE PORTIONS OF THE
CARDIFF AND OLIVENHAIN TRUNK SEWER MAIN
SYSTEMS
WHEREAS, the Cardiff Sanitation District owns and maintains the Cardiff and
Olivenhain Trunk Sewers located in the communities of Cardiff and Olivenhain; and
WHEREAS, the Sewer Trunk Mains have been found by the District Engineer to be in
need of repair, and has been budgeted for capital improvements as part of the FY 1994-95
Capital Improvement Program; and
WHEREAS, alternate construction methods have been investigated and the District
Engineer has determined that the "Insituform" rehabilitation method is the only acceptable
procedure in lieu of alternate methods which are unfeasible; and
WHEREAS, it is appropriate to rehabilitate the Cardiff and Olivenhain Trunk Sewer
Mains using the "Insituform" method; and
WHEREAS, the "Insituform" process is a patented construction method and the
Insituform Southwest Company owned exclusive territorial rights to this construction method in
the San Diego County area; and
WHEREAS, sufficient documentation exists and has been reviewed by the District
Engineer to assure that a fair price can be negotiated; and
WHEREAS, there is no benefit to the Cardiff Sanitation District to spend additional staff
time and advertising monies to bid this project publicly; and
WHEREAS, the Attorney for the District has determined that sufficient case law
precedence exists to support the award of a sole source construction contract in the
circumstances described above in which no benefit is gained from public bidding.
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the Cardiff
Sanitation District does hereby make the following findings:
1.
There are no satisfactory construction methods other than the " Insituform "
process which can be implemented to rehabilitate the Cardiff and Olivenhain
Trunk Sewer Main Systems.

There is only one licensed contractor in San Diego County that can perform the
"Insituform" construction method.
3.
The nature of this construction contract is such that competitive proposals are
unavailable and would not produce an advantage. The advertisement and
competitive bid of this project would therefore by undesirable and impractical.
NOW THEREFORE, BE IT FURTHER RESOLVED by the Broad of Directors of the
Cardiff Sanitation District that the District authorizes the District Manager to negotiate a price
with Insituform Southwest to rehabilitate the Cardiff and Olivenhain Trunk Sewer Main Systems.
PASSED, APPROVED AND ADOPTED at a Regular Meeting by the Board of Directors
