RESOLUTION NO. C-87-06
A RESOLUTION OF THE CARDIFF-BY-THE-SEA
COMMUNITY ADVISORY BOARD DENYING A
DESIGN REVIEW PERMIT FOR TWO ZERO LOT
LINE SINGLE FAMILY DWELLINGS
AT 2136 and 2140 GLASGOW AVENUE, CARDIFF
WHEREAS, Jerry Peters applied for a Design Review permit for
two single family zero-lot line dwellings on two lots as per
section 23.08.030, B, 6, of the Design Review Ordinance of the
City of Encinitas;
WHEREAS, a public hearing was conducted on the application
by the Cardiff-by-the-Sea Community Advisory Board
on August 12,
1987, and all persons desiring to be heard were heard; and
WHEREAS, evidence was submitted and considered to include
without limitation:
a.
site plan submitted by the applicant;
b.
written information submitted with the application;
c.
Oral testimony from staff, applicant, and public made a
part of the record at said public hearing;
d.
CAB staff report dated August 12, 1987, which is
incorporated by this reference as though fully setforth
herein; and
e.
Additional written documentation.
NOW THEREFORE,
Cardiff-by-the-Sea
BE IT RESOLVED by the
Community Advisory Board of the City of Encinitas that the Design
Review permit is hereby denied based on the following findings:
1.
That the proposed project is not in conformance with
the intent of Section 23.08.74, A of the Design Review
Ordinance;
2.
That the proposed proj ect is not in conformance with
the intent of Section 23.08.74, B of the Design Review
Ordinance;

3.
That the proposed proj ect is not in conformance with
the intent of section 23.08.79, A of the Design Review
Ordinance;
4.
The project design does not preserve significant public
views to the extent possible, and does not offer
mitigation for lost views. Public views are defined as
those views provided from public property; and
5.
The project does not protect to the extent possible,
some of the significant view enjoyed by the residents
of nearby properties.
PASSED AND ADOPTED this 12th day of August,
1987, by the
