APPROVING A CONDITION AIIBNDKBNT

D, 2.G, and eliminating Attachment A of the Olivenhain Community
Advisory Board Resolution of approval

allowing the
findings to exceed mid-range density to be eliminated as set forth
in City Council Ordinance 91-05, adopted on March 1, 1991; and
WHEREAS, a public hearing was conducted by the Olivenhain
Community Advisory Board on May 7, 1991, as required by law, and
all persons desiring to be heard were heard.
NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community
Advisory Board
of

that
the
proposed
Tentative Parcel Map Condition Amendments for property being 284
Rancho Santa Fe Road, Parcel 4 of Parcel Map No. 15145, County of
San Diego, is hereby APPROVED based upon the following findings:
a.
That the proposed map is consistent wi th applicable
general and specific plans as specified in Section 65451
of the Subdivision Map Act.
b.
That the design or improvement of the proposed
subdivision is consistent with applicable general and
specific plans since the project is in conformance with
the General Plan designation for the site of Rural
Residential at a maximum of 2 dwelling units per acre.
c.
That the site is physically suitable for that type of
development, in that the two parcels are proposed to be
developed in single family dwelling units which is

consistent with the RR-2 zoning
development standards for the site.
That the site is physically suitable for the proposed
density of development, since the topography and design
of the lots can be adequately accommodated as proposed.

That the design of the subdi vision and the proposed
improvements are not likely to cause substantial
environmental damage or substantially and avoidably
injure fish or wildlife or their habitat, and a Negative
Declaration was certified for the Tentative Parcel Map
89-058 TPM on June 20,1989 by the City of Encinitas, and
is on file in the Department of Planning and Community
Development.
That the design of the subdivision or type of
improvements is not likely to cause serious public health
problems, since documentation has been obtained stating
that utilities shall be available for the site, and that
the subject site shall annex into the Cardiff Sanitation
District.
That the design of the subdi vision or the type of
improvements will not conflict with easements, acquired
by the public at large, for access through or use of,
property within the proposed subdivision.
NOW THEREFORE,

D.
The property owner will be contributing $2,000 for
each dwelling unit for a total of $4,000 in Park
Fees in addition to the required Park Fees, all of
which shall be paid prior to final map approval.
Standard fees based on square footage shall be paid
prior to issuance of building permits.
E.
The design of the homes is required to be reviewed
through the Design Review application process to
ensure that the design of the homes will be above
average.
