OL-91-009 A RESOLUTION OF OLIVENHAIN COMMUNITY ADVISORY BOARD DENYING A TENTATIVE PARCEL MAP EXTENSION (91-014-TPM/EXT; FOR 87-136-TPM) FOR PROPERTY BEING PARCEL 4 OF PARCEL MAP NO. 12666, COUNTY OF SAN DIEGO, CITY OF ENCINITAS WHEREAS, Al F. Mayo, submitted Tentative Parcel Map a Extension application required by the City of as Encinitas Subdivision Ordinance, for the purpose of extending the expiration period for a Tentative Parcel Map subdividing one 7 acre parcel into three lots of 2.3,2.0, and 2.3 net acres respectively; and WHEREAS, public hearings were conducted by the Olivenhain Community Advisory Board on April 2, and May 7, 1991, as required by law, and all persons desiring to be heard were heard. NOW THEREFORE, BE IT RESOLVED by the Oli venhain Community Advisory Board of the City of Encinitas, that the proposed Tentative Parcel Map Extension for property being Parcel 4 of Parcel Map No. 12666, County of San Diego, City of Encinitas is hereby DENIED based upon the following findings: a. The proposed map is not consistent with applicable general and specific plans as specified in Section 65451 of the Subdivision Map Act. The map is not consistent with the Circulation Element of the City of Encinitas General Plan since Highway SA 680 rights-of-way are not reserved on the map as required in City Council Resolution 90-60. b. The authorized agency shall consider the current circumstances of the subdivision, the site and the surrounding area when reviewing an extension request and the tentative map and conditions of approval shall remain substantially unchanged from the tentative map as originally approved. A need to alter or add conditions, attach additional development fees, or alter map design or number of units shall be grounds for denial of the LN/CAB28-302wp . . . time extension. Pursuant to City Council Resolution 90- 60 the SA 680 rights-of-way are required to be shown on the map. The map as approved is not consistent with the current City regulations, since the map was not designed to accommodate and dedicate the 102' width of SA680, and was not reviewed and conditioned to require noise attenuation measures to be incorporated into the design of the project to mitigate the noise from SA680, and therefore is not in conformance with City Council Resolution 90-60. NOW THEREFORE, that BE IT RESOLVED Tentative Parcel Map Extension 91-014-TPM/EXT (for 87-136-TPM) is hereby DENIED.
