A RESOLUTION OF THE OLIVENHAIN
COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW
PERMIT FOR THE HOMES ON 2 SINGLE FAMILY LOTS,
THE ENTRY GATE, MAIL BOXES, AND STREET LANDSCAPE
FOR PROPERTY BEING PARCEL 3 AS SHOWN ON
CERTIFICATE OF COMPLIANCE RECORDED
ON MARCH 28, 1985, FILE/PAGE NO. 85-105101
COUNTY OF SAN DIEGO AS DESCRIBED IN ATTACHMENT "A"
AND LOCATED ON LONE JACK ROAD WEST OF FORTUNA RANCH ROAD
(CASE NO. 90-248-DR, BRUCE D. WIEGAND, INC.)
WHEREAS, Bruce D. wiegand, Inc., applied for a Design
Review
permit for construction of the homes on 2 single family lots, the
entry gate,
mail boxes,
and street landscape as
required by
Planning Commission approval of TM-88-115 the Tentative Subdivision
Map for the project,
and Chapter 23.08, the city of Encini tas
Design Review Ordinance;
and
WHEREAS, public hearings were conducted on the application
by the Olivenhain Community Advisory Board on March 5, and March
19, 1991, and all persons desiring to be heard were heard: and
WHEREAS,
evidence was submitted and considered to include

Blue line plans for lot 2 dated October 22, 1990 with 6
sheets consisting of a site plan (pg. 1), floor plans
(pg. 2), elevations (pgs. 3-6); and for lot 7 dated
October 22, 1990 with 7 pages consisting of a site plan
(pg. 1), floor plans (pgs. 2 & 3), elevations (pgs. 4-
7); and blue line street landscape, entry gate, and call
box/mail box plans dated received by the City of
Encinitas on January 21, 1991.

NOW THEREFORE,
BE IT RESOLVED by the Olivenhain Community
Advisory Board of the City of Encinitas that the Design Review
Permit for 90-248-DR for construction of the homes on 2 single
family lots (lots 2 and 7), the entry gate, call box/mail boxes,
and street landscape is hereby approved subject to the following
findings:

The project is compatible in structural size (bulk and
mass) to adjacent properties and neighborhood, since they
are of similar size to several of the estate homes on the
developments to the south and in the Country Rose
development to the east, and are compatible in
architectural style with the rural character of
Olivenhain and are compatible neighboring properties.
The proposed project is in conformance with section
23.08.72 of the Design Review Ordinance, since the
project is consistent with the existing General Plan in
land use allowing one dwelling unit per two acres and
requiring that care be given to minimal grading and
of~ering of recreational trails that connect to the
Recreation Element trails system, and natural
environmental features are being retained since the pads
are proposed on a small portion of the lots, and all
utilities are available to the site;

The proposed project is in conformance with section
23.08.74 of the Design Review Ordinance, since the
project has reduced the grading to prevent excessively
high graded slopes, and reduced the overall amount of
grading to retain as much of the site in its natural
state as possible:

The proposed project is in conformance with section
23.08.76 of the Design Review Ordinance, since the
exterior materials for the project have been coordinated
to be compatible with each other and the surrounding
area, and the proposed structures are compatible with the
size and scale of other single family structures in the
surrounding neighborhoods and they will be within the
required height limits for the zone:

The proposed proj ect is in conformance with Section
23.08.077 of the Design Review Ordinance, since the
street landscaping proposed will help create a buffer for

the private lots and two trees are proposed per lot
rather than the required one tree per lot for residential
developments: graded slopes will be planted to minimize
erosion: and a recreational trail is being developed as
per city standards.
BE IT ALSO RESOLVED, that the Design Review Permit is approved
with the following conditions:

The project is approved as submitted on the blue line
plans for lot 2 dated October 22, 1990 with 6 sheets
consisting of a site plan (pg. I), floor plans (pg. 2),
elevations (pgs. 3-6); and for lot 7 dated October 22,
1990 with 7 pages consisting of a site plan (pg. 1),
floor plans (pgs. 2 & 3), elevations (pgs. 4-7): and blue
line street landscape, entry gate, and call box/mail box
plans dated received by the city of Encinita~ on January
21, 1991.
Prior to the city Building Department issuing a final
inspection on framing, the applicant shall provide to the
Department of Planning and community Development a survey
from a Civil Engineer as to the building height in
conformance with this Design Review approval.
C.
That a plan be submitted for approval by the Director of
Planning and Community Development, the city Engineer,
and the Encinitas Fire Protection District regarding the
treatment of the site during the construction phase, and
the circulation and parking of construction workers'
vehicles and any heavy equipment needed for the
construction of the project.
D.
All required plantings and approved irrigation systems
shall be in place prior to use or occupancy of new
buildings or structures. All required plantings shall
be maintained in good growing conditions, and whenever,
necessary shall be replaced with new plant materials to
ensure continued compliance with applicable landscaping,
buffering, and screening requirements as setforth in the
landscape plan dated received by the city of Encinitas
on January 21, 1991 and on file in the Department of
Planning and community Development. All landscaping and
associated automatic irrigation systems shall be
maintained in a manner that will not depreciate adjacent
property values and otherwise adversely affect adjacent
properties.

order to activate the light only when needed for vehicle
entry.
The maintenance of the call box shall be accomplished
through requirements setforth in the private road
maintenance agreement that was required to be established
for the subdivision as Condition 7,E of Planning
Commission Resolution of approval PC 88-25.
The height of the entry gate, call box/mailbox structure,
and fencing shall be in conformance with the city of
En~initas height standards.
The remaining homes in the subdivision shall not be
reviewed through the Design Review process at the CAB
level if they are in conformance with the new Design
Review regulations set forth in Chapter 23.08 of the
Municipal Code.
Fire Protection
1.
Prior to delivery of combustible building materials on
site, water and sewer systems shall satisfactorily pass
all required tests and be connected to the public water
and sewer systems. In addition, the first lift of
asphalt paving shall be in place to provide adequate,
permanent access for emergency vehicles. Said access
shall be maintained to the satisfaction of the Fire
District.
J.
All two-way traffic aisles shall be a minimum of 24 feet
wide and emergency access shall be provided, maintained
free and clear a minimum of 24 feet wide at all times
du':ing construction in accordance with Fire District
requirements.

Submit a letter from the Fire District stating
satisfaction with the type and location of fire hydrants
and the minimum water flow in gallons per minute together
with a letter to the appropriate agency certifying that
the fire department's minimum required water flow is
available to serve the project. provisions shall be made
to ensure a maximum water pressure at the hydrant of 250
psi. The installation of a pressure reducing station may
be required. Fire hydrants shall be of a bronze type and
shall be identified by installing a "blue" reflective dot
on the street surface pursuant to Fire District
Standards.
L.
Address numbers shall be clearly visible from the street
fronting the structure. Where structures are located off
a roadway on long driveways, a monument shall be placed

at the entrance where the driveway intersects the main
roadway. Permanent address numbers shall be displayed
on this monument.
M.
structures shall be protected by automatic fire sprinkler
systems. sprinkler systems shall be installed to the
satisfaction of the Encinitas Fire Protection District.
N.
Prior to final recordation, the applicant shall submit
a letter from the Fire District stating that all
development impact, plan check and/or cost recovery fees
have been paid or secured to the satisfaction of the
District.

A complete plan review will be done at the time of
submittal for plancheck.
