1991-02 8 8 8 RESOLUTION NO. OL-91-002 A RESOLUTION OF OLIVENHAIN COMMUNITY ADVISORY BOARD APPROVING A CONDITION AMENDMENT (90-271-TPM/CA; FOR TENTATIVE PARCEL MAP 87-108-TPM) FOR PROPERTY LOCATED ON PORTIONS OF LOTS 81 AND 81A, COLONY OF OLIVENHAIN, MAP 326, COUNTY OF SAN DIEGO AND AS FURTHER DESCRIBED IN THE ATTACHED EXHIBIT "A" WHEREAS, D. Gary Child, submitted a Tentative Parcel Map Condition application required City of Amendment as by the Encinitas Municipal Code for the purpose of amending Condition 4,B of the Olivenhain Community Advisory Board Resolution of approval 0-87-019 allowing two private driveway accesses off of Rancho Santa Fe Road instead of the previously required private roads on the approved tentative parcel map 87-108-TPM; and WHEREAS, a public hearing was conducted by the Olivenhain Community Advisory Board on January 22, 1991, as required by law, and all persons desiring to be heard were heard. NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community Advisory City Encinitas, proposed Board the of that the of Tentative Condition property being Parcel Map Amendment for portions of Lots 81 and 81A, Colony of Olivenhain, Map 326, county of San Diego and as further described in the attached Exhibit "A", is hereby APPROVED based upon the following findings: a. That the proposed map is consistent with applicable general and specific plans as specified in Section 65451 of the Subdivision Map Act. b. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans since the project is in conformance with 8 . 8 c. d. e. f. g. the General Plan designation for the site of Rural Residential at a maximum of 2 dwelling units per acre. That the site is physically suitable for that type of development, in that the four parcels are proposed to be developed in single family dwelling units which is consistent with the RR-2 zoning designation and development standards for the site. That the site is physically suitable for the proposed density of development, since the topography and design of the lots can be adequately accommodated as proposed. That the design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat, and a Negative Declaration was certified for the Tentative Parcel Map 87-108-TPM on December 8, 1987 by the City of Encinitas, and is on file in the Department of Planning and Community Development. That the design of the subdivision or type of improvements is not likely to cause serious public health problems, since documentation has been obtained stating that utilities shall be available for the site, and that the subject site shall annex into the Cardiff Sanitation District. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. BE IT RESOLVED that Tentative Parcel Map Condition NOW THEREFORE, Amendment 90-271 TPM/CA (for 87-108-TPM) , amending Condition 4,B is hereby APPROVED to read as follows: 4. PUBLIC ROAD AND PRIVATE ROAD IMPROVEMENTS B.
