1990-27 . . . " RESOLUTION NO. OL-90-27 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT FOR 10 SINGLE FAMILY LOTS AND ONE PARK LOT FOR PROPERTY BEING PARCELS 2 AND 3 OF PARCEL MAP NO. 10387 IN THE COUNTY OF SAN DIEGO (CASE NO. 90-229-DR, VENTURE PACIFIC) WHEREAS, Venture Pacific, applied for a Design Review permit for construction of 10 single family dwelling units, and one park lot, and the associated landscaping, and recreational trails, as required by Planning commission approval of TM-89-173 the Tentative Subdivision Map for the project, and Chapter 23.08, the City of Encinitas Design Review Ordinance; and WHEREAS, public hearings were conducted on the application by the Olivenhain Community Advisory Board on November 20, and December 4, 1990, and all persons desiring to be heard were heard; and WHEREAS, evidence was submitted and considered to include witheut limitation: a. Blue line plans with 22 pages dated revised November 28, 1990 to include: site development plans pgs. 2 & 3; Wiro Park landscape and planting plan pgs. 4 & 5; Irrigation plan for park and detail of specifications pgs. 6 & 7; SF/DU planting plan pg. 8; SF/DU irrigation plan pg. 9; SF/DU details and specifications pgs. 10 & IIi Plan 1 floor plans pg. 12, elevations pgs. 13 & 14; Plan 2 fleer plans pg. 15, elevations pgs. 16, 17, & 18; Plan 3 floor plans pg. 19, elevations pgs. 20, 21 & 22; and Color schemes Appendix A - Sheet 18A LN/CAB24-263wp . . . b. c. d. e. Written information submitted with the application; Oral testimony from staff, applicant, and public made a part of the record at said public hearings; CAB staff reports (90-229-DR) dated November 15, and November 29, 1990 which are on file in the office of Planning and Community Development; and Additional written documentation. NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community Advisory Board of the city of Encinitas that the Design Review Permit for 90-229-DR for 10 single family lots, and one park lot, to include landscaping, design of the homes, improvements and landscaping te the park and the improvements and landscaping of the findings: recreational trails is hereby approved subject to the following 1. 2. 3. That the projection out of the building envelope for Lots 2 and 7 does not significantly impact the views of adjacent properties, in that the project takes advantage of views while maintaining some of the significant views enj oyed by residents of nearby properties, since the topography of the site, maintenance of a considerable amout of the existing vegetation on site, and the design of the homes does net significantly block any more of the view than is presently blocked. That the project is compatible in structural size (bulk and mass) to adjacent properties and neighborhood, since they are of similar size, and are compatible in architectural style with the neighboring properties. That the preposed proj ect is in conformance with Section 23.08.72 of the Design Review Ordinance, since the project is consistent with the existing General Plan in land use allowing two dwelling units per acre and requiring that care be given to minimal grading and offering of recreational trails that connect to the Recreation Element trails system, and significant envirenmental features are being retained and all utilities are available to the site; LN/CAB24-263wp . . . 4. That the proposed project is in conformance with section 23.08.74 of the Design Review Ordinance, since the project has reduced the grading to prevent excessively high graded slopes, and reduced the overall amount of grading to retain as much of the site in its natural state as possible; 5. That the proposed project is in conformance with Section 23.08.76 of the Design Review Ordinance, since the exterior materials for the project have been coordinated to be compatible with each other and the surrounding area, and the proposed structures are compatible with the size and scale of other single family structures in the surrounding neighborhoods and they will be of similar heights; 6. That the proposed project is in conformance with section 23.08.077 of the Design Review Ordinance, since the landscaping proposed will help create privacy for the individual lots, some draught tolerant and native planting is being utilized, graded slopes will be planted to minimize erosion, and a recreational trail and park lot are being developed as per City standards, and additional planting on the street is proposed; and 7. That the impact of the proposed development on the site and the surrounding area is being mitigated by measures that have been designed into the project that are minimal grading, planting .of slopes, additional landscaping, a recreatienal trails and a park lot, and house designs that retain some of the significant views for the surrounding properties. BE IT ALSO RESOLVED, that the Design Review Permit is approved with the following conditions: A. The project is approved as submitted on the blue line plans with 22 pages dated revised November 28, 1990 to include: site development plans pgs. 2 & 3; Wiro Park landscape and planting plan pgs. 4 & 5; Irrigation plan for park and detail of specifications pgs. 6 & 7; SF/DU planting plan pg. 8; SF/DU irrigation plan pg. 9; SF/DU details and specifications pgs. 10 & 11; Plan 1 floor plans pg. 12, elevations pgs. 13 & 14; Plan 2 floor plans pg. 15, elevations pgs. 16, 17, & 18; Plan 3 floor plans pg. 19, elevations pgs. 20, 21 & 22; and Color schemes Appendix A - Sheet 18A LN/CAB24-263wp . . G. . B. Prior to the city Building Department issuing a final inspection on framing, the applicant shall provide to the Department of Planning and Community Development a survey from a civil Engineer as to the building height in conformance with this Design Review approval. c. That a plan be submitted for approval by the Director of Planning and Community Development, the City Engineer, and the Encinitas Fire Protection District regarding the treatment of the site during the construction phase, and the circulation and parking of construction workers' vehicles and any heavy equipment needed for the construction of the project. That recreational trails and the park lot be dedicated and improved prior to final inspection and occupancy as required on the final map for 89-173-TM on file in the Department of Planning and Community Development. All park furniture that is constructed of concrete shall be painted or colored in brown to blend in with the natural elements of the park. D. E. The house on lot 7 is approved with a maximum height of 27' to the peak and the chimney height of 30'. The house on Let 2 is approved with a maximum chimney height of 29 I 6". F. Fruiting mulberry plants shall be incorporated into the landscape plan as shown on the park and proj ect landscape and planting plans dated revised November 28, 1990 and shown on pages 4 , 5, and 8 . The actual Wiro House profile shall be utilized on the Wiro Park sign with this modification to be submitted and approved by the Director of Planning and Community Development. All required plantings and approved irrigation systems shall be in place prior to use or occupancy of new buildings or structures. All required plantings shall be maintained in good growing conditions, and whenever, necessary shall be replaced with new plant materials to ensure continued compliance with applicable landscaping, buffering, and screening requirements as setforth in the landscape plan dated revised November 28, 1990 and on file in the Department of Planning and Cemmunity Development. All landscaping and associated automatic irrigation systems shall be maintained in a manner that will not depreciate adjacent property values and .otherwise adversely affect adjacent properties. Prior to delivery of combustible building materials on site, water and sewer systems shall satisfactorily pass all required tests and be connected to the public water and sewer systems. In addition, the first lift of asphalt paving shall be in place to provide adequate, permanent access for emergency vehicles. Said access shall be maintained to the satisfaction of the Fire District. I. All two-way traffic aisles shall be a minimum of 24 feet wide and emergency access shall be provided, maintained free and clear a minimum of 24 feet wide at all times during construction in accordance with Fire District requirements. J. Submit a letter from the Fire District stating satisfaction with the type and location of fire hydrants and the minimum water flow in gallons per minute together with a letter to the appropriate agency certifying that the fire department's minimum required water flow is available to serve the project. Provisions shall be made to ensure a maximum water pressure at the hydrant of 250 psi. The installation of a pressure reducing station may be required. Fire hydrants shall be of a bronze type and shall be identified by installing a "blue" reflective dot on the street surface pursuant to Fire District Standards. Address numbers shall be clearly visible from the street fronting the structure. Where structures are located off a roadway on long driveways, a monument shall be placed at the entrance where the driveway intersects the main roadway. Permanent address numbers shall be displayed on this monument. Structures shall be protected by automatic fire sprinkler systems. Sprinkler systems shall be installed to the satisfaction of the Encinitas Fire Protection District. Prior to final recordation, the applicant shall submit a letter from the Fire District stating that all development impact, plan check and/or cost recovery fees have been paid or secured to the satisfaction of the District.
