A RESOLUTION OF OLIVENHAIN COMMUNITY ADVISORY BOARD
APPROVING A TENTATIVE PARCEL MAP EXTENSION
(90-184-TPH/EXT; FOR TPH 18928),
FOR PROPERTY LOCATED ON E STREET BETWEEN LONE JACK ROAD
AND CAMINO DEL NORTE
AND AS FURTHER DESCRIBED IN THE ATTACHED EXHIBIT "A"

WHEREAS,
James Statser,
submi tted a Tentative Parcel Map
Extension
application
required
city
Encinitas
as
by
the
of
Subdivision Ordinance, for the purpose of extending the expiration
period for a Tentative Parcel Map subdividing a one acre parcel
into two lots of .50 net acres each; and

WHEREAS, public hearings were conducted by the Olivenhain
community Advisery Board on september 4, October 16, and November

20,1990, as required by law,
and all persons desiring to be heard
were heard.
NOW THEREFORE, BE IT RESOLVED by the Olivenhain community
Advisory
City
Encinitas,
the proposed
Board
of
the
of
that
Tentative Parcel Map Extension for property being located on E
Street between Lone Jack Road and Camino del Norte and as further
described in the attached exhibit "A", is hereby
APPROVED based
upon the following findings:
a.
That the proposed map is consistent with applicable
general and specific plans as specified in section 65451
of the Subdivisien Map Act.

That the design or improvement of the proposed
subdivision is consistent with applicable general and
specific plans since the project is in conformance with
the General Plan designation for the si te of Rural
Residential at a maximum of 2 dwelling units per acre.
That the site is physically suitable for that type of
development, in that the two parcels are proposed to be
developed in single family dwelling units which is
consistent with the RR-2 zoning designation and
development standards for the site.
That the site is physically suitable for the preposed
density of development, since the topography and design
of the lots can be adequately accommodated as proposed.

That the design of the subdivision and the proposed
improvements are not likely to cause substantial
environmental damage or substantially and avoidably
injure fish or wildlife or their habitat, and a Negative
Declaration was certified for the Tentative Parcel Map
(TPM 18928) on July 21, 1987 by the city of Encinitas,
and is on file in the Department of Planning and
community Development.
f.
That the design of the subdivision or type of
improvements is not likely to cause serious public health
problems, since documentation has been obtained stating
that utilities shall be available for the site, and that
the subject site shall annex into the Cardiff Sanitation
District.
g.
That the design of the subdivision or the type of
improvements will not conflict with easements, acquired
by the public at large, for access through or use of,
property within the proposed subdivision.
The environmentally constrained lands are adequately
protected since ~here are no significant environmental
features of the site.
h.

The project meets the standards to exceed mid-range
density pursuant to section 30.16.010, B, 2 of the
Municipal Code since the proj ect is offering improvements
that will be of needed public benefit by extending the
sewer to allow the neighboring properties to connect to
sewer since some of the septic systems are failing in the
area.

The TPM is compatible with the neighboring properties and
community character.

Per the Negative Declaration certified July 21, 1987
there is no evidence of environmentally sensitive land
in the project.
NOW THEREFORE,
BE IT RESOLVED that Tentative Parcel Map
Extension 90-184-TPM/EXT (for TPM 18928) is hereby APPROVED.
PASSED AND ADOPTED this 20th day of November, 1990, by the
following vote, to wit:
