1990-24 . . . RESOLUTION NO. OL-90-24 A RESOLUTION OF OLIVENHAIN COMMUNITY ADVISORY BOARD DENYING A TENTATIVE PARCEL MAP EXTENSION (90-183-TPM/EXT; FOR 88-052-TPM) FOR PROPERTY LOCATED OFF OF DOVE HOLLOW ROAD AT THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 4, TOWNSHIP 13 SOUTH, RANGE 3 WEST SAN BERNARDINO BASE AND MERIDIAN, COUNTY OF SAN DIEGO AND AS FURTHER DESCRIBED IN THE ATTACHED EXHIBIT "A" WHEREAS, Gary Buckameir, submitted a Tentative Parcel Map Extension application required City of Encinitas by the as Subdivision Ordinance, for the purpose of extending the expiration period for a Tentative Parcel Map subdividing one 10.5 gross acre parcel into four lots of 3.25, 2.0, and 2 . 0 net acres 2.0, respectively; and WHEREAS, a public hearing was conducted by the Olivenhain Community Advisory Board on September 4, September 18, and October 16,1990, as required by law, and all persons desiring to be heard were heard. NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community Advisory City Board of Encinitas, of the that the proposed Tentative Parcel Map Extension for property being located off of Dove Hollow Road at the northwest quarter of the southwest quarter of the southwest quarter of section 4, township 13 south, range 3 west San Bernardino base and meridian, County of San Diego and as further described in the attached exhibit "A", is hereby DENIED based upen the following findings: LN/CAB20-242wp . . . a. That the proposed map is not consistent with applicable general and specific plans as specified in section 65451 of the Subdivision Map Act since the project does not meet the density requirements in the RR zone. b. That the design or improvement of the proposed subdivision is not consistent with applicable general and specific plans since the project is not in conformance with the General Plan designation for the site of Rural Residential at a mid-range density of .38 dwelling units per acre, and sufficient findings cannot be made to approve the project to exceed mid-range density. c. That the site is not physically suitable for the proposed density of development, since the City of Encinitas subdivision and road improvement standards and the zoning code development standards have changed and the project would need to be redesigned to meet the mid-range density. Adequate evidence has not been submitted to support the findings to exceed mid-range density. d. The project does not meet the standards to exceed mid- range density pursuant to section 30.16.010, B, 2 of the Municipal Code since the applicant is not offering improvements that significantly exceed the standard requirements for a four lot Tentative Parcel Map; and the project design does not significantly exceed the minimum standards for development since the map is requesting maximum density with three of the lots at minimum lot size. e. The authorized agency shall consider the current circumstances of the subdivision, the site and the surrounding area when reviewing an extension request and the tentative map and conditions of approval shall remain substantially unchanged from the tentative map as originally approved. A need to alter or add conditions, attach additional development fees, or alter map design or number of units shall be grounds for denial of the time extension. Evidence has not been submi tted to support the whether the map as previously approved would meet the City standards in effect this date. NOW THEREFORE , IT RESOLVED that Tentati ve BE Parcel Map Extension 90-183-TPM/EXT (for 88-052-TPM) is hereby DENIED.
