RESOLUTION NO. OL-90-022
A RESOLUTION OF OLIVENHAIN COMMUNITY ADVISORY BOARD
APPROVING A TENTATIVE PARCEL MAP (90-053-TPM/EIA)
AND CERTIFYING A NEGATIVE DECLARATION
FOR PROPERTY LOCATED ON PORTION OF LOTS 3 AND 4
IN SECTION 8, TOWNSHIP 13 SOUTH, RANGE 3 WEST,
SAN BERNARDINO BASE AND MERIDIAN, AND AS
FURTHER DESCRIBED IN ATTACHMENT "A"
WHEREAS, Olivenhain Farms, submitted a Tentative Parcel Map
application as required by the city of Encinitas Subdivision
Ordinance, for the purpose of subdividing one 15.18 gross acre site
into four lots of 6.33, 2.61, 2.16 and 2~42 net acres; and
WHEREAS, public hearings were conducted by the Olivenhain
community Advisory Board on June 5, July 17 and september 4, 1990,
as required by law,
and all persons desiring to be heard were

NOW THEREFORE,
BE IT RESOLVED by the Olivenhain community
Advisory
Board
of
the
City
of
Encinitas,
that
the
proposed
Tentative Parcel 'Map for property as described in Attachment "A",
is hereby approved, and may exceed midrange density based upon the
follewing findings:
a.
That the prepesed map is censistent with applicable
general and specific plans as specified in sectien 65451
of. the Subdivisien Map Act.
b.
That the design .or improvement .of the prepesed
subdivision is censistent with applicable general and
specific plans since the preject is in confermance with
the General Plan designation for the site.
c.
That the site is physically suitable fer that type .of
. develepment, in that the feur parcels are prepesed te be
develeped in single family dwelling units which is
censistent with the RR zening designatien and develepment
standards fer the site.

That the site is physically suitable for.the propesed
density .of development, since the tepography and design
of the lots can be adequately accommodated as preposed.

That the design of the subdivision and the propesed
improvements are not likely to cause substantial
envirenmental damage .or substantially and avoidably
injure fish or wildlife or their habitat, and a Negative
Declaration is hereby certified for the Tentative Parcel
Map (90-053-TPM/EIA) on this date, September 4,1990, and
is on file in the Department of Planning and community
Development. .
That the design of the subdivision .or type .of
improvements is not likely to cause serious public health
problems, since documentation has been .obtained stating
that utilities shall be available for the site, and that
the subtect site shall annex into the Cardiff Sanitatien
District. .

That the design of the subdivision or the type of
improvements will not cenflict with easements, acquired
by the public at large, for access threugh or use of,
property within the propesed subdivisien.
The environmentally constrained lands are adequately
protected since the areas of concern are being setaside
in private open space easements that tetal 5.71 acres.
Additionally, the .open space provides fer cennectien te
open space areas reqUired en previeus maps thereby
creating centigueus open space and prometing the cencept
of wildlife cerriders through Olivenhain. The preject
is previding trail markers with specific text en the
histery .of the area and documentatien of the native plant
and animal species 'feund in that area of Olivenhain. A
bridge is being constructed ever the drainage ceurst te
access the prepeseQ parcels. .

The preject shews high sensitivity te the neighbering
preperties and area te ensure cempatibility with land
uses and cemmunity character since the lets have been
designed te be .of similar .or larger size than these in
the surreunding area (average let area is 3.8 acres); the
pads are prepesed te be accemplished with minimal grading
and are designed te run parallel with the tepegraphy of
the lets; the pads are being prepesed at lewer elevations
than the surreunding preperties that are presently
develeped, thereby allewing fer the censtructien .of a
standard 26' high structure te be at a lewer elevatien
which weuld preserve existing views fer the presently
developed lots in the area.

The project design significantly exceeds the minimum
standards fer development in that the net lot size for
the RR Zone is 2 acres and the project preposes average
lot sizes of 3.8 acres, with the largest lot at 6.33
acres. Additionally, the lot depths and lot widths
proposed far exceed the requirements of 150 feet minimum
let depth and 110 feet minimum lot width in the RR Zone.
Finally, due to the pad lecations, the homes which will
be constructed will maintain larger setbacks than the
required minimum setbacks in the RR-Zone, and pads can
be accomplished parallel with the centours of the lot so
as to necessitatate minimal grading.

The project provides other significant benefits by
retaining maj .or pertion of the site in open space;
censtruction .of a' bridge over the drainage area; and
providing t:r;:ail head markers on the historic significance
of the area, and markers designating the plant and animal
species significant to the area. Additienally, a public
recreational trail shall be improved en site as shown on
the map dated revised at the meeting of September 4,
1990, and to the satisfactien of the Director of
Community Services,.in additien to the submittal of the
regular park fees required on the project.
NOW THEREFORE, BE IT RESOLVED that Tentative Parcel Map 90-
053-TPM dated and received by the city on August 16,
1990 and
revised at the meeting .of september 4,
1990 is hereby approved

homes in accordance 'with the standards set forth in the
Design Review Ordinance.

signs, and landscape, and a standard cevenant shall be

parcels 3 and 4 as shewn en the map dated received August
16,1990 and revised at the meeting of September 4,1990.
This open space is required as a bielegical .open space

District.
All designated emergency access reads shall be pested
pursuant te the Fire District standards.
Submit a letter from the Encinitas Fire District stating
satisfaction with the type and location of fire hydrants
and ,the minimum required water flow in gallons per minute
tegether with a letter from the apprepriate agency
certifying that the fire department's minimum required
water flew is available te serve the site. previsions
shall be made te ensure a maximum water pressure at the
fire hydrant .of 150 psi. The installatien .of a pressure
reducing statien may be required. Fire hydrants shall
be .of a brenze type and shall be identified by installing
a "blue" reflective det en the street surface pursuant
te Fire District standards.
Submit a letter frem the Fire District stating that

approach shall not exceed the maximum approved by the

maintain the temporary basins and eresion control
,measures for a period of time satisfactory to the City
Engineer and shall guarantee their maintenance and
satisfactory perfermance threugh cash depesit and bonding
in amounts and types suitable to the City Engineer.

The proposed proj ect falls wi thin areas indicated as
subject to flooding under the National Flood Insurance
Program and is subject te the previsions of that program
and City Ordinance.

shall be analyzed to determine the detentien basin
