RESOLUTION NO. 92-12
RESOLUTION OF APPLICATION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
"MARILYN BROWN-BELLMAN"
WHEREAS,this Board of Directors has received a request from
Marilyn Brown-Bellman that the hereinafter described territory to
be annexed to the Cardiff Sanitation District (hereinafter
referred to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1.
Pursuant to Government Code Sections 56800 and
56700, application is hereby made to the Local Agency Formation
Commission of the County of San Diego for a proposed change
of organization as follows:
A.
This proposal is made pursuant to the Cortese-Knox
Local Government Reorganization Act of 1985
(S. 56000, et. seq., Govt. Code).
B.
The nature of the proposed change of organization
and the names of all districts for which any such
change of organization is proposed as follows:
The annexation of the hereinafter described
territory to the Sanitation District.
C.
The names of all other affected counties, cities
and districts are: City of Encinitas.
D.
A description of the exterior boundaries of the
territory proposed to be annexed to the Sanitation
District is described in Exhibit "A" hereto
attached.
E.
Said territory is uninhabited and comprises
approximately 16.0 acres.
F.
It is proposed that said territory be annexed
subject to the following condition: Payment of
District annexation and state Board fees.

G.
All the owners of land within such territory
have given their written consent to such
annexation subject to the aforementioned terms and
conditions.
H.
The reasons for this proposal are as follows:
(1)
The Sanitation District is empowered to and
is engaged in furnishing sewage disposal
facilities.
(2)
The territory proposed to be annexed to
said District is developed and/or proposed to
be developed and used for residential and/or
commercial purposes and provision for
sewerage disposal facilities for said
territory is essential for such purposes.

It is hereby requested that proceedings be taken
for the annexation of territory as hereinabove
proposed.
J.
This annexation is consistent with the sphere of
influence of the Sanitation District.
2.
Pursuant to the State CEQA Guidelines Sections 15074
and 15301 (California Environmental Quality Act of
1970), the Board finds that this annexation would not
have a significant effect on the environment and is
categorically exempt from evaluation.
3.
The Clerk of the Board of Directors is hereby
authorized and directed to file a certified copy of
this resolution with the Executive Officer of the Local
Agency Formation Commission of the County of San Diego.

EXHIBIT "A"
That portion of the North Half of Section 22, Township 13 South,
Range 4 West, San Bernardino Meridian, in the City of Encinitas,
County of San Diego, State of California, according to United
States Government Survey approved April 19, 1881, described as
follows:
1)
BEGINNING at the Southeast corner of the Northwest Quarter of
said Section 22, said point being the midpoint of said Section
22 as shown on MAP OF CARDIFF VISTA, in the City of Encinitas,
County of San Diego, State of California, according to Map
thereof No. 1547, filed in the Office of the County Recorder
of San Diego County.
2)
Thence North 00°01'30" East along the Easterly line of said
Northwest Quarter a distance of 290.77 feet to the
Northwesterly corner of the land conveyed to Perry W.
Kempster, et ux, by deed 'recorded July 26, 1965 as Document
No. 132893 of Official Records, said corner hereinafter
designated Point "A".

Thence continuing along said Easterly line North 00 °01' 30"
East, 225.00 feet to a point hereinafter designated Point "B".
4)
Thence retracing said course South 00°01'30" West, 515.77 feet
to the POINT OF BEGINNING.
5)
Thence South 89°34'00" West along the Southerly line of said
Northwest Quarter a distance of 530.04 feet to the Southeast
corner of RIDGEWAY HEIGHTS, in the City of Encinitas, County
of San Diego, State of California, according to Map thereof
No. 2163, filed in said County Recorder's Office.
Thence North 07°13'00" West along the Easterly line of said
Map No. 2163 a distance of 974.58 feet to the Southwest corner
of land conveyed to Fred Katsumi Nakagawa, et ux, by deed
recorded February 15, 1950 in Book 3545, Page 270 of Official
Records.
Thence North 89°16'00" East along the Southerly line of said
Nakagawa land 344.47 feet.
Thence North 03°59'55" West along the Easterly line of said
Nakagawa land and continuing along the Westerly line of the
land conveyed to Tashi Funaki by deed recorded January 29,
1953 in Book 4759, Page 74 of Official Records a distance of
352.22 feet to:the intersection with the Westerly prolongation
of the Southerly line of the Northwest Quarter of the
Northeast Quarter of said Section 22.
Thence North 89°16'00" East along said prolongation 332.86
feet to the Southeast corner of the Northeast Quarter of the
