RESOLUTION NO. 91-29
RESOLUTION OF APPLICATION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
uBUHAHN RIDGE SEWER GROUP ANNEXATION"
WHEREAS,this Board of Directors has received a request from
Bmnann Ridge Sewer Group that the hereinafter described territory to
be annexed to the cardiff Sanitation District (hereinafter referred to
as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1.
Pursuant to Government Code Sections 56800 and 56700,
application is hereby made to the Local Agency Formation
Comnission of the County of San Diego for a proposed change
of organization as follows:
A.
This proposal is made pursuant to the Cortese-Knox
Local Government Reorganization Act of 1985 (S.
56000, et. seg., Govt. Code).
B.
The nature of the proposed change of organization and
the names of all districts for which any such change
of organization is proposed as follows: The
annexation of the hereinafter described territory to
the Sanitation District.
C.
The names of all other affected counties, cities and
districts are: City of Encinitas.
D.
A description of the exterior boundaries of the
territory proposed to be annexed to the Sanitation
District is described in Exhibit NAN hereto attached.
E.
Said territory is inhabited and comprises
approximately 4.78 acres.
F.
It is proposed that said territory be annexed subj ect
to the following condition: Payment of District
élImexation and State Board fees.

G.
All the owners of land within such territory have
given their written consent to such annexation subject
to the aforementioned terms and conditions.
H.
The reasons for this proposal are as follows:
(1)
The Sanitation District is empowered to and is
engaged in furnishing sewage disposal
facilities.
(2)
The territory proposed to be annexed to said
District is developed and/or proposed to be
developed and used for residential and/or
commercial purposes and provision for sewerage
disposal facilities for said territory is
essential for such purposes.

It is hereby requested that proceedings 1:;>e taken for
the annexation of territory as hereinabove proposed.
J.
This annexation is consistent with the sphere of
influence of the Sanitation District.
2.
Pursuant to the State CEQA Guidelines Section 15074
(california Environmental Quality Act of 1970), the Board
finds that this annexation would not have a negative impact
on the environment.
3.
The Clerk of the Board of Directors is hereby authorized
and directed to file a certified copy of this resolution
with the Executive Officer of the Local Agency Formation
Commission of the County of San Diego.

BUMANN RIDGE SEWER GROUP ANNEXATION
All those portions of Blocks 32 and 37 TOGETHER WITH those portions
6th, 7th, liE," and "F" Streets as vacated by the County of San
Diego Board of Supervisors, lying within the COLONY OF OLIVENHAIN,
in the City of Encinitas, County of San Diego, State of California,
according to Map Thereof No. 326, filed in the Office of the County
Recorder of San Diego County, July 8, 1885, described as follows:
PARCEL "A"
1) BEGINNING at the Southwest corner of Parcell of Parcel Map
No. 15333, in the City of Encinitas, County of San Diego, State of
California, filed in said County Recorder's Office, August 4,1988,
said corner also being the intersection of the centerline of said
6th Street with the Easterly line of the Westerly 10.00 feet of
said "F" Street.
2) Thence along said Easterly line, said line also being the
Westerly line of said Parcell, North 15°07'21" East, 746.78 feet
to the Southerly line of the Northerly 20.00 feet of said Block 32.
3) Thence along said Southerly line North 73°21'17" West, 324.27
feet to the Westerly line of the Easterly 12.00 feet of "E" Street.
4) Thence along said Westerly line, South 15°06'14" West, 140.00
feet to the Westerly prolongation of the Southerly line of the
