A RESOLUTION OF THE OLIVENHAIN
COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW
PERMIT FOR THE GRADING, NOISE ATTENUATION WALLS,
AND LANDSCAPING FOR 9 SINGLE FAMILY RESIDENTIAL LOTS,
ONE OPEN SPACE LOT AND ONE EQUESTRIAN LOT
IN THE RR-2 ZONE FOR PROPERTY BEING THOSE PORTIONS
OF LOT 18 OF THE SUBDIVISION OF THE RANCHO LAS ENCINITAS
COUNTY OF SAN DIEGO, HAP NO. 848, AND AS
FURTHER DESCRIBED IN THE ATTACHED EXHIBIT "A",
(CASE NO. 90-017-DR)
WHEREAS, Michael Dalen and Gunter Enz, applied for a Design
Review permit
grading,
noise
attenuation walls,
and
for the
landscaping for 9 single family residential lots, one open space
lot and one equestrian lot in the RR-2 zone for property being
those portions of Lot 18 of the subdivision of the Rancho Las
Encinitas,
County of San Diego,
and as further
Map No.
848,
described in the attached Exhibit "A", as required by Planning
commission

the
Subdivision Map for the project, and Chapter 23.08, the City of
Encinitas Design Review Ordinance;
and
WHEREAS, public hearings were conducted on the application
by the Olivenhain Community Advisory Board on March 20, and May 8,
1990, and the resolution was reviewed at the meeting of May 22,
1990 and all persons desiring to be heard were heard; and
WHEREAS, evidence was submitted and considered to include
without limitation:

Grading plan dated April 5, 1990, landscape plans dated
April 17, 1990, and section sheet dated February 16,1990
received by the City of Encinitas on April 25, 1990 and
submitted by the applicant;
written information submitted with the application;
Oral testimony from staff, applicant, and public made a
part of the record at said public hearing;
CAB staff reports (90-017-DR) dated March 14, and April
30, 1990 which are on file in the office of Planning and
Community Development; and
Additional written documentation.
NOW THEREFORE, BE IT RESOLVED by the Ol i venhain Community
Advisory Board of the City of Encinitas that the Design Review
Permit for 90-017-DR for the grading, noise attenuation walls, and
landscaping for 9 single family residential lots, one open space
lot and one equestrian lot is hereby approved subj ect to the
following findings:

That the proposed proj ect is in conformance with Section
23.08.72 of the Design Review Ordinance, since the
project is consistent with the existing General Plan in
land use allowing two dwelling units per acre and
requiring that care be given to minimal grading and
offering of recreational trails that connect to the
Recreation Element trails system, and significant
environmental features are being retained and all
utilities are available to the site;

That the proposed project is in conformance with Section
23.08.74 of the Design Review Ordinance, since the
project has reduced the grading to prevent excessively
high graded slopes, provided for split level pads for
housing, and reduced the overall amount of grading to
retain some of the character of the natural topography
of the site. Noise barriers have been required as shown
on the section sheet dated February 16,1990 and received
by the City of Encinitas on April 25, 1990 and shall not
be changed without review and approval through the Design
Review Modification process by the authorized agency.
Noise barriers shall be constructed on Lot Nos. 1,9,8,
and 7 as shown on the abovementioned section Sheet, at
no less than five feet above the building pad. (As
required in the Negative Declaration on file in the
Tentative Map Case No. 88-209-TM/EIA).

3.
That the proposed project is in conformance with section
23.08.077 of the Design Review Ordinance, since the
landscaping proposed will help create privacy for the
individual lots, a considerable amount of draught
tolerant planting is being utilized, graded slopes will
be planted to minimize erosion, and a portion of the site
on the east of Lone Jack Road (Lot 11) is being required
to be developed as an equestrian center lot.
Additionally, an open space easement is required over Lot
10. Alteration of landform, removal or disturbance of
vegetation, introduction of non-native vegetation,
erection of structures of any type, and vehicle access
shall be prohibited. Livestock shall be prohibited and
fences erected to prevent their encroachment. The
required recreation trail shall be located at the east
boundary on or adjacent to the existing unimproved road
to minimize disturbance of wetland habitat.
BE IT ALSO RESOLVED, that the Design Review Permit is approved
with the following conditions:

The project is approved as submitted on the Grading plan
dated April 5, 1990, landscape plans dated April 17,
1990, and section sheet dated February 16, 1990 received
by the City of Encinitas on April 25, 1990 and submitted
by the applicant, and on file in the Department of
Planning and community Development, and shall not be
altered without Community Advisory Board review and
approval.
B.
That a plan be submitted for approval by the Director of
Planning and Community Development, the City Engineer,
and the Encinitas Fire Protection District regarding the
treatment of the site during the construction phase, and
the circulation and parking of construction workers 1
vehicles and any heavy equipment needed for the
construction of the project.
C.
That recreational trails and equestrian center be
dedicated and improved prior to final inspection and a
final plan submitted for review and approval by the
Director of Planning and Community Development and the
Director of Community Services. The trails are approved
as shown on the plans dated April 17, 1990 and received
by the City on April 25, 1990, and redlined at the CAB
meeting of May 22, 1990, and on fil& in the Department
of Planning and Community Development.

D.
That the grading plan dated April 5, 1990 be approved
with the exception of the grading on Lot 5 which is
approved with the pad elevation lowered 41 (from 144
elevation to 140 elevation) in order to ensure that a
single story home on that lot will not silhouette above
or block the ridge line in conformance with condition 2.G
in Planning Commission Resolution PC 89-15 which states:
"Lots 2,3,4, and 5 shall be developed with low profile
houses not to exceed 16' above the highest pad elevation
on the upper pad in order not to silhouette above or
block the ridge line, and with development of all lots
in the subdivision required to go through Design Review."
E.
That an estimate be submitted to the Director of Planning
and Community Development for approval as a security
deposit for removal of the temporary irrigation system
on Lot 10, and that the approved amount be submitted to
the City for said purpose.
F.
That real rock be used on the noise wall pilasters.
G.
Prior to the building department approving the connection
to the buildings to the private sewer or water systems
located in the private right of way, the civil engineer
responsible for the design and the inspector responsible
for the system inspectionmust certify in writing to the
Director of Public Works that the sewer and/or water
systems were designed and constructed in accordance with
the utility district or agency standards for public
systems.
FIRE
H.
Prior to delivery of combustible building materials on
site, water and sewer systems shall satisfactorily pass
all required tests and be connected to the public water
and sewer systems. In addition, the first lift of
asphalt paving shall be in place to provide adequate,
permanent access for emergency vehicles. Said access
shall be maintained to the satisfaction of the Fire
Department.
I.
All designated emergency access roads shall be posted
per the Fire Department.

J.
K.
Submit a letter from the Encinitas Fire Protection
District stating satisfaction with the type and location
of Fire hydrants and the minimum required water flow in
gallons per minute together with a letter from the
appropriate agency certifying that the fire department's
minimum required water flow is available to serve the
site. Fire hydrants shall be of a bronze type and shall
be identified by installing a "blue" reflective dot on
street surface as per Fire Department standards.
Cul-de-sacs shall be designed to meet a minimum paved
radius of 40 feet to ensure adequate turn around.
L.
All two-way traffic aisles shall be a minimum of 24 feet
wide and emergency access shall be provided, maintained
free and clear, a minimum of 24 feet wide at all times
during construction in accordance with Fire Department
requirements.
M.
All structures shall be protected by fire sprinkler
systems per N.F.P.A. standards, and shall be installed
to the satisfaction of the Encini tas Fire Protection
District.
N.
All streets improved to 241 width shall be posted for no
parking on both sides of the street.
o.
Address numbers shall be clearly visible from the street
fronting the structure. Where structures are located off
a roadway on long driveways, a monument shall be placed
at the entrance where the driveway intersects the main
roadway. Address numbers shall be displayed on this
monument.
P.
Install one residential type bronze fire hydrant.
Location shall be at the private road on the west side
of Lone Jack Road between Lots 4 and 5.
