1990-02 . 8 8 RESOLUTION NO. OL-90-02 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW MODIFICATION PERMIT FOR THE GRADING, LANDSCAPING AND CONSTRUCTION OF ONE SINGLE FAMILY DWELLING UNIT (89-223-DR/MOD) FOR PROPERTY BEING LOT 14 OF BROOKSIDE SUBDIVISION COMMONLY KNOWN AS 3256 BROOKSIDE LANE, ENCINITAS WHEREAS, Jon Ewing, applied for a Design Review Modification the grading, landscaping and construction of 1 single family dwelling unit on Lot 14, of the Brookside Subdivision at 3256 Brookside Lane, Encinitas as required by Chapter 23.08, the City of Encinitas Design Review Ordinance and the Olivenhain Community Advisory Board Resolution of approval (OL-89-006) for Pacific Scene Case No. 88-265-DR; and WHEREAS, a public hearing was conducted on the application by the Olivenhain Community Advisory Board on February 6, 1990 and all persons desiring to be heard were heard; and WHEREAS, evidence was submitted and considered to include without limitation: a. site plan, elevations, landscaping and grading plans submitted by the applicant; Written information submitted with the application; Oral testimony from staff, applicant, and public made a part of the record at said public hearing; CAB staff report (89-223-DR/MOD) dated January 10, 1990 which is on file in the office of Planning and Community Development; and Additional written documentation. b. c. d. e. NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community Advisory Board of the City of Encinitas that the Design Review LN/CAB13j-172wp 8 Modification Permit for 89-223-DR/MOD for Lot 14 of the Brookside Subdivision for 1 single family lot is hereby approved subject to the following findings: 8 4. 5. 1. That the proposed proj ect is in conformance with section 23.08.72 of the Design Review Ordinance, since the proj ect is consistent with the existing and proposed General Plan in land use allowing one dwelling unit per 2 acres and lot averaging where significant environmental features are being retained and all utilities are available to the site; 2. That the proposed project is in conformance with Section 23.08.74 of the Design Review Ordinance, since the project has reduced the grading to prevent excessively high graded slopes, provided for a low profile design with parking at a lower level, and reduced the overall amount of grading to retain as much of the site in its natural state as possible; 3. That the proposed project is in conformance with section 23.08.76 of the Design Review Ordinance, since the exterior materials for the project have been coordinated to be compatible with each other and the surrounding area, and the proposed structure is compatible with the size and scale of other single family structures in the surrounding neighborhood and it is of similar or lesser height; That the proposed project is in conformance with section 23.08.077 of the Design Review Ordinance, since the landscaping proposed will help create privacy for the individual lot, draught tolerant planting is being utilized, graded slopes will be planted to minimize erosion, and a major portion of the site is being retained in its natural topography; and That the impact of the proposed development on the site and the surrounding area is being mitigated by measures that have been designed into the project. BE IT ALSO RESOLVED, that the Design Review Permit is approved with the following conditions: A. The project is approved as submitted on the elevations and site plans dated January 10, 1990 and received at the CAB 8 LN/CAB13j-172wp 8 8 8 B. meeting of February 6, 1990, which are on file in the Department of Planning and Community Development, and shall not be altered without Community Advisory Board review and approval. Prior to the City Building Department issuing a final inspection on framing, the applicant shall provide to the Department of Planning and Community Development a survey from a civil Engineer as to the building height in conformance with this Design Review approval. C. That a plan be submitted for approval by the Director of Planning and Community Development, the City Engineer, and the Encinitas Fire Protection District regarding the treatment of the site during the construction phase, and the circulation and parking of construction workers' vehicles and any heavy equipment needed for the construction of the project. D. That the landscape plan is approved as submitted on the plans dated SeDtember 20.1989 on file in the Department of Planning and Community Development, and as modified at the CAB meeting of February 6, 1990 (which shall be resubmitted and reviewed by staff), and shall not be altered without Community Advisory Board review and approval. E. That recreational trail as approved on the original Design Review Case 88-265-DR for Pacific Scene be dedicated and improved prior to final inspection and occupancy as shown on the Trail Map labeled Exhibit D, dated April 10, 1989, and on file in the Department of Planning and Community Development. APPLICANT SHALL CONTACT THE PUBLIC WORKS DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: F. Gradinq Conditions 1. The owner shall obtain a grading permit prior to the commencement of any clearing or grading of the site. 2. The grading for this project is defined in Chapter 23.24 of the Encini tas Municipal Code. Grading shall be performed under the observation of a civil engineer whose responsibility it shall be to coordinate site inspection and testing to ensure compliance of the work with the approved grading plan, submit required reports to the City Engineer and verify compliance with Chapter 23.24 of the Encinitas Municipal Code. LN/CAB13j-172wp 7 8 8 8 G. 3. No grading shall occur outside the limits of the PROJECT unless a letter of permission is obtained from the owners of the affected properties. All slopes within this project shall be no steeper than 2: 1. 4. 5. A soils/geological/hydraulic report (as applicable) shall be prepared by a qualified engineer licensed by the state of California to perform such work at first submittal of a grading plan. 6. Prior to hauling dirt or construction materials to any proposed construction site within this project the owner shall submit to and receive approval from the City Engineer for the proposed haul route. The owner shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. Drainaqe Conditions: 1. The owner shall exercise special care during the construction phase of this project to prevent any offsite siltation. The owner shall provide erosion control measures and shall construct temporary desiltation/detention basins of type, size and location as approved by the City Engineer. The basins and erosion control measures shall be shown and specified on the grading plan and shall be constructed to the satisfaction of the City Engineer prior to the start of any other grading operations. Prior to the removal of any basins or facilities so constructed the area served shall be protected by additional drainage facilities, slope erosion control measures and other methods required or approved by the City Engineer. The owner shall maintain the temporary basins and erosion control measures for a period of time satisfactory to the City Engineer and shall guarantee their maintenance and satisfactory performance through cash deposit and bonding in amounts and types suitable to the City Engineer. A drainage system capable of handling and disposing of all surface water originating within the project and all surface waters that may flow onto the proj ect from adjacent lands, shall be required. Said drainage system shall include any easements and structures as required by the City Engineer to properly handle the drainage. 2. LN/CAB13j-172wp 8 8 8 8 H. I. Fire 3. Concentrated flows across driveways and/or sidewalks shall not be permitted. 5. 6. utilities 1. The developer shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. 2. The owner shall be responsible for coordination with S.D.G. & E., Pacific Telephone, and Cable TV authorities. 1. Prior to delivery of combustible building materials on site, water and sewer systems shall satisfactorily pass all required tests and be connected to the public water and sewer systems. In addition, the first lift of asphalt paving shall be in place to provide adequate, permanent access for emergency vehicles. Said access shall be maintained to the satisfaction of the Fire Department. 2. All designated emergency access roads shall be posted per the Fire Department. 3. Submit a letter from the Encinitas Fire Protection District stating satisfaction with the type and location of Fire hydrants and the minimum required water flow in gallons per minute together with a letter from the appropriate agency certifying that the fire department's minimum required water flow is available to serve the site. Fire hydrants shall be of a bronze type and shall be identified by installing a "blue" reflective dot on street surface as per Fire Department standards. 4. Submit a letter from the Encinitas Fire District stating that fire/fuel breaks have been provided to the satisfaction of the Department. Cul-de-sacs shall be designed to meet a minimum paved radius of 40 feet to ensure adequate turn around. All two-way traffic aisles shall be a minimum of 24 feet wide and emergency access shall be provided, maintained free and clear, a minimum of 24 feet wide at all times during construction in accordance with Fire Department requirements. LN/CAB13j-172wp 9 8 . 8 7. All structures shall be protected by fire sprinkler systems per N.F.P.A. standards, and shall be installed to the satisfaction of the Encinitas Fire Protection District. 8. All streets improved to 24' width, or less, shall be posted for no parking on both sides of the street, and signs shall be posted that read "parking off the street only" . 9. Address numbers shall be clearly visible from the street fronting the structure. Where structures are located off a roadway on long driveways, a monument shall be placed at the entrance where the driveway intersects the main roadway. Address numbers shall be displayed on this monument. 10. Prior to final recordation, the applicant shall submit a letter from the fire district stating that all development impact, plan check and/or cost recovery fees have been paid or secured to the satisfaction of the District.
