1989-18 . . . RESOLUTION NO. OL-89-018 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT FOR 1 SINGLE FAMILY DWELLING UNIT TO EXCEED THE 26' HEIGHT LIMIT FOR A CHIMNEY (89-166-DR) FOR PROPERTY BEING PARCEL 1 OF PARCEL MAP NO. 12942, COUNTY OF SAN DIEGO, (COMMONLY KNOWN AS 3300 DOVE HOLLOW DRIVE, ENCINITAS WHEREAS, Patrick McIntosh, applied for a Design Review permit for construction of one single family dwelling unit to exceed the allowed 26' height limit for a chimney by 2 I, as required by Chapter 23.08, the City of Encinitas Design Review Ordinance, and Section 30.16.010,B,7 of the Zoning Code; and WHEREAS, a public hearing was conducted on the application by the Olivenhain Community Advisory Board on September 19, 1989 and all persons desiring to be heard were heard; and WHEREAS, evidence was submi tted and considered to include without limitation: a. site plan submitted by applicant; written information submitted with the application; Oral testimony from staff, applicant, and public made a part of the record at said public hearing; CAB staff report (89-166-DR) dated September 5, 1989 which is on file in the office of Planning and Community Development; and Additional written documentation. b. c. d. e. NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community Advisory Board of the City of Encinitas that the Design Review Permit is hereby approved subject to the following findings: PM/04/CAB15 1464wp5 (10/20/89-1)1 . . . 1. The portion of the building outside of the standard envelope maintains some of the significant views enjoyed by residents of nearby properties. The proposed projection is a 30" wide chimney extending two feet above the 26 foot building envelope. The nearest structure adjacent to the subject site is to the south with a garage approximately 20 feet from the subject site's southerly property line. The predominant views of this structure are to the west. No views impacts are identified. The property to the west is vacant. That the building is compatible in bulk and mass with buildings on neighboring properties. The surrounding homes are two story ranging from 2600 to 4000 square feet in area. The lots are 2 to 4 acres. The proposed home is two stories at 4000 square feet in area with a three car garage. The bulk and mass of the structure is minimized with the overall design, stepping the second story back from the first floor for the front and both side portions of the structure. 2. BE IT ALSO RESOLVED, that the Design Review Permit is approved with the following conditions: A. The project is approved as submitted on the elevations and site plans dated August 1, 1989, on file in the Department of Planning and Community Development, and shall not be altered without Community Advisory Board review and approval. B. Prior to the City Building Department issuing a final inspection on framing, the applicant shall provide to the Department of Planning and Community Development a survey from a Ci viI Engineer as to the building height in conformance with this Design Review approval. C. That a plan be submitted for approval by the Director of Planning and Community Development, the City Engineer, and the Encinitas fire Protection District regarding the treatment of the site during the construction phase, and the circulation and parking of construction workers' vehicles and any heavy equipment needed for the construction of the project. Prior to delivery of combustible building materials on site, water and sewer systems shall satisfactorily pass all required tests and be connected to the public water and sewer systems. In addition, the first lift of asphalt paving shall be in place to provide adequate, permanent access for emergency vehicles. Said access shall be maintained to the satisfaction of the Fire Department. Submit a letter from the Encinitas Fire Protection District stating that fire/fuel breaks have been provided to the satisfaction of the District. E. 2. 3. All two-way traffic aisles shall be a minimum of 24 feet wide and emergency access shall be provided, maintained free and clear, a minimum of 24 feet wide at all times during construction in accordance with Fire Department requirements. Driveway shall be paved with a minimum width of 16 feet. 4. Fire District review fee shall be paid prior to final inspection. Gradina Conditions 1. The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. 2. The grading for this project is defined in Chapter 23.24 of the Encinitas Municipal Code. Grading shall be performed under the observation of a civil engineer whose responsibility it shall be to coordinate site inspection and testing to ensure compliance of the work with the approved grading plan, submit required reports to the City Engineer and verify compliance with Chapter 23.24 of the Encinitas Municipal Code. 3. No grading shall occur outside the limits of the (SUBDIVISION/PROJECT) unless a letter of permission is obtained from the owners of the affected properties. 4. A separate grading plan shall be submitted and approved and a separate grading permit issued for the borrow or disposal site if located within the city limits. PM/04/CAB15 1464wp5 (10/20/89-1)3 . . . F. G. 5. All slopes within this project shall be no steeper than 2:1. 6. A soils/geological/hydraulic report (as applicable) shall be prepared by a qualified engineer licensed by the state of California to perform such work at first submittal of a grading plan. 7. Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the ci ty Engineer may impose wi th regard to the hauling operation. Drainage Conditions: A drainage system capable of handling and disposing of all surface water originating within the property, and all surface waters that may flow onto the property from adjacent lands, shall be required. Said drainage system shall include any easements and structures as required by the ci ty Engineer to properly handle the drainage. street Conditions 1. 1. Reciprocal access and maintenance and/or agreements shall be provided ensuring access to all parcels over private roads, drives or parking areas and maintenance thereof to the satisfaction of the Director of Public Works. 2. The design of all private streets and drainage systems shall be approved by the City Engineer prior to (APPROVAL OF THE FINAL MAP/ISSUANCE OF ANY GRADING OR BUILDING PERMIT) for this project. The structural section of all private streets shall conform to City of Encinitas Standards based on R- value tests. The standard improvement plan check deposit is required. The developer shall comply with all rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. The developer shall be responsible for coordination with S.D.G. & E., Pacific Telephone, and Cable TV authorities. 2. 3. All proposed utilities within the project shall be installed underground including existing utilities unless exempt by the Municipal Code. The developer shall be responsible for the relocation and undergrounding of existing public utilities, as required. 4.
