1989-02 . . . RESOLUTION NO. OL-89-002 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT AND CERTIFYING THE NEGATIVE DECLARATION (88-335-DR/EIA) FOR ONE SINGLE FAMILY DWELLING FOR PROPERTY BEING PARCEL 3 OF PARCEL MAP NO. 11513, COUNTY OF SAN DIEGO, AND AS DESCRIBED IN EXHIBIT "A" ATTACHED HERETO (COMMONLY KNOWN AS 2123 ENCINITAS BOULEVARD, OLIVENHAIN) WHEREAS, Arthur Adelstein applied for a Design Review Permi t and environmental review for the grading of a single family dwelling unit and to allow a single family dwelling unit to exceed the interim height envelope set forth in City Council Ordinance 87-80 by 2' 6" to the highest point of the parapet of the roof as 2123 Encinitas property commonly known Boulevard, Olivenhain; WHEREAS, public on the hearing conducted a was application by the Olivenhain Community Advisory Board on February 7, 1989, and all persons desiring to be heard were heard; and WHEREAS, evidence was submitted and considered to include without limitation: a. b. Site plan submitted by the applicant; written information submitted with the application; Oral testimony from staff, applicant, and public made a part of the record at said public hearing; CAB staff report (88-335-DR/EIA) dated January 31, 1989 which is on file in the office of Planning and Community Development; and Additional written documentation. c. d. e. NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community Advisory Board of the City of Encinitas that the Design Review Permit for 88-335-DR/EIA for one single family dwelling unit LN/CAB11c-070wp (1/31/89) . . . is hereby approved and the Negative Declaration for the grading is hereby certified subject to the following findings: 1. That the projection out of the building envelope does not significantly impact the views of adjacent properties, in that the proj ect takes advantage of views and/or protects, to the extent possible some of the significant view enjoyed by the residents of nearby properties, since the surrounding properties are either significantly lower or higher than the subject site. There are no properties directly adjacent to the site on the north, south or east that presently have significant views through the site and the structures to the west of the site are located on significantly higher ground and will retain significant view over the subject site. 2. That the proj ect is compatible in structural size (bulk and mass) to adjacent properties and neighborhood, since the proposed structure as called out on the plans dated November 1, 1988 and on file in the Department of Planning and Community Development, is of a similar size and bulk as are several other single family dwelling units in the same vicinity. BE approved subject to the following conditions: Design Review Permit is IT ALSO RESOLVED that the 1. Project is approved as submitted and dated November 1, 1988, and shall not be altered without Community Advisory Board review and approval. 2. Prior to the City Building Department issuing a final inspection on framing, the applicant shall provide a survey from a civil Engineer as to the building height. 3. Grading of the subject property shall be in accordance with the City of Encinitas Grading Ordinance, and mitigation measures required in the Negative Declaration herein Certified and on file in the Department of Planning and Community Development. 4. A soils/geological/hydraulic report (as applicable) shall be prepared at first submittal of a grading plan, by a qualified engineer licensed by the State of California to perform such work. 5. Reciprocal access and maintenance and/or agreements shall be provided ensuring access to all parcels over private roads, drives or parking areas and maintenance thereof to the satisfaction of the Director of Public Works. 7. A drainage system capable of handling and disposing of all surface water originating within the development, and all surface waters that may flow onto the development from adj acent lands, shall be required. said drainage system shall include any easements and structures as required by the Director of Public Works to properly handle the drainage. 8. Concentrated flows across driveways and/or sidewalks shall not be permitted. 9. An automatic fire sprinkler system shall be installed as per NFPA 13 or 13D, with 1" water meter minimum allowable. 10. A Mitigation Monitoring and Reporting Program, and determination of the additional funds needed to be submitted for that program shall be determined by the Directors of Planning and Community Development and Public Works.
