PUBLIC HEARINGS CONTINUED A. 89-297 TM/RPL/EIA CASE NUMBER: APPLICANT: Wayne Wagner LOCATION: Easterly terminus of Camino Del Rancho DESCRIPTION: A proposed 9 lot tentative map for single family homes in the RR-2 Zone. Item previously went through conceptual review at Staff Advisory Committee. Item continued from the meeting of May 22, 1990. ENVIRONMENTAL STATUS: Under Review Motion: Board Kember DuVivier - To recommend approval of the project to the Planning Commission as proposed with a condition that the road be private with an IOD of 60' and paved to a 24' width; to accept the contour grading proposed as a return to the natural grade prior to borrow pit operations being conducted, therefore the height of any structures can be measured from the grade created by the contour grading to match the old natural grade; a private road maintenance agreement is required; design review required for any future development as setforth in the City design review standards; the IOD to the north on Regal Ridge is to remain on the map. Project includes landscaping, an entry gate, and walls. Item continued from the meeting of May 22, 1990. ENVIRONMENTAL STATUS: Negative Declaration certified (See 88- 231 Harley Denk) Motion: Board Member Trujillo - To approve the project with planting to be added to the landscape plan (to be reviewed and approved by staff) for the slopes to include bushy shrubs and trees that will fill in between the taller straight trees proposed and hide the slope better; Plan 2B shall be modified to eliminate the wood half timbers; the new color is approved as submitted; changes to house sitting on the pads approved; elimination of Plan 1A approved with the addition of Plan 1C (new site plan and elevation plans to be submitted for the file). ENVIRONMENTAL STATUS: Under review Motion: Board Kember Johnson - To approve the proj ect as submitted with the condition that the applicant make additions to the landscape plan. The revised landscape plan shall be submitted to staff for review and approval. B. 90-104 TPM/EXT CASE NUKBER: APPLICANT: Dennis Hauswirth LOCATION: 13th street (between Rancho Santa Fe Road and IICII Street) DESCRIPTION: Request for a time extension of TPM 18962 to allow for improvements and filing of parcel map. The subdivision consists of 4 lots in the RR-2 Zone. ENVIRONMENTAL STATUS: Negative Declaration certified Kotion: Board Kember Trujillo - To approve the project based upon the following findings: No evidence of unnecessary delay on the applicant's part; applicant was victimized by unlawful grading on his site; there appears to have been more than a normal processing time due to engineering requirements; there was a delay due to the requirement to separate the adjacent property from the map drawings for this map; the map was originally approved by the current council; substantial funds have been expended on the parcel map, improvement plans, etc. JO/03/CAB16-1841wp5 (7-10-90-5) 8 . . . . . (not including attorney fees for the illegal grading law suite); Pat Kurphy's March 19, 1990 letter to Mr. Hauswirth supported the project as having vested rights (which would support substantial funds being expended as well). ENVIRONMENTAL STATUS: Under Review Kotion: Board Kember Johnson - To approve the project in concept with environmental documentation and the resolution of approval to return to the community Advisory Board on consent at the meeting of July 17, 1990. Realignment of the Pacific Scene The Board was concerned wi th the impacts on the environmentally sensitive open space and requested that a design review modification be submitted for public hearing review, substantial conformance changes not approved.
