Motion: Board Kember DuVivier - To recommend approval of the
project to the Planning Commission as proposed with a
condition that the road be private with an IOD of 60' and
paved to a 24' width; to accept the contour grading proposed
as a return to the natural grade prior to borrow pit
operations being conducted, therefore the height of any
structures can be measured from the grade created by the
contour grading to match the old natural grade; a private road
maintenance agreement is required; design review required for
any future development as setforth in the City design review
standards; the IOD to the north on Regal Ridge is to remain
on the map.

planting to be added to the landscape plan (to be reviewed and
approved by staff) for the slopes to include bushy shrubs and
trees that will fill in between the taller straight trees
proposed and hide the slope better; Plan 2B shall be modified
to eliminate the wood half timbers; the new color is approved
as submitted; changes to house sitting on the pads approved;
elimination of Plan 1A approved with the addition of Plan 1C
(new site plan and elevation plans to be submitted for the
file).

Kotion: Board Kember Trujillo - To approve the project based
upon the following findings: No evidence of unnecessary delay
on the applicant's part; applicant was victimized by unlawful
grading on his site; there appears to have been more than a
normal processing time due to engineering requirements; there
was a delay due to the requirement to separate the adjacent
property from the map drawings for this map; the map was
originally approved by the current council; substantial funds
have been expended on the parcel map, improvement plans, etc.
