Variance request to encroach to feet into the 15-foot Side Yard Setback (or 5 feet into the to-foot Side Yard Setback) for a portion of a proposed 2-car garage for property that is split-zoned Rural Residential (RR) and Rural Residential-2 (RR-2) and located at 2542 Fifth Street. Applicant: Charles Dederich I Ken Ringer, Architect. Case No. 94-173 V. Environmental status: The project has been found exempt from Environmental Review pursuant to Section 15303(a) of the California Environmental Quality Act (CEQA). Contact Planner: Craig Olson. STAFF RECOMMENDATION: Receive public testimony and review the required findings for approving the Variance request. Should the Community Advisory Board determine that findings can be made for Variance approval, adopt the Resolution of Approval presented in the Agenda Report, with conditions as presented by staff or as may be amended by the Board. Motion: Board Member Jordan - To make the Findings and adopt the Resolution as presented by staff approving Case No. 94-173 V. Second: Board Member Bode. Variance request to allow a portion of a proposed three car garage to encroach 15 feet into the 30-foot Front Yard Setback, and for fencing to exceed the 4-foot height standard to six and eight feet within 15 feet of the front yard property line, and for a portion of the side yard wall to exceed the six foot height standard to eight feet for property located at 2814 Crystal Ridge Road. Applicant: Ronald and Lisa Pepper. Case No. 94-167 V. Environmental status: The project has been found exempt from Environmental Review pursuant to Section 15303(a) of the California Environmental Quality Act (CEQA). Contact Planner: Craig Olson. STAFF RECOMMENDATION: Receive public testimony and review the required findings to approve the Variance request. Continue the public hearing to the Board's next regularly scheduled meeting on December 6, 1994 to allow time for the applicant to submit information requested in the Agenda Report submitted to the Community Advisory Board and any additional information requested by the Board. Motion: Board Member Jordan - To continue the public hearing to the meeting of December 6, 1994 with the following direction from the Board: H. (4) Second: Vote: (1) Approve the Variance to wall heights within the 15-foot area measured from the front yard property line as presented in the revised plan submitted by the project designer. The revised design includes six foot heights for the columns on either side of the driveway entry pte and the architectural feature (archway design) at a height of 8 feet above the walkway entry. (2) The side yard wall which was originally shown at a height of 8 feet for a portion of the wall along the northerly property line was redesigned to six feet and, therefore, does not require Variance approval from the Board. (3) The rear yard wall at the top of the slope was shown on revised plans to be setback approximately three feet from the retaining wall to allow for a landscaped planter area in conformance with Code requirements and, therefore, the rear yard wall does not require Variance approval from the Board. The design of tIûs wall is not within the Board's authority to review since it meets Municipal Code standards. However, the Board advises the property owner to design the rear wall in confonnance with any private CC&Rs which may exist for the property. Reopen the public testimony portion of the hearing and continue the portion of the application request concerning the encroachment of the proposed garage into the 30-foot Front Yard Setback. The applicant is to provide an alternative design for the Board's review so they may assess the fmding of whether or not the alternate design would have less of an impact on acijacent properties than the original design which showed a 15 foot encroachment.
