OL-92-13 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD APPROVING A TIME EXTENSION TENTATIVE PARCEL MAP OF THREE SINGLE FAMILY RESIDENTIAL LOTS LOCATED AT THE TERMINUS OF WHISPERWIND DRIVE (CASE NO. 91-187 TPM/EXT) FOR A WHEREAS, a request for consideration of time extension for Tentative Parcel Map 89-140 was filed by Kimball/MacDonald for three single family residential lots located at the terminus of Whisperwind Drive and legally described as; Parcell of PARCEL MAP NO. 10526, as filed in the Office of the County Recorder of said San Diego County, October 2, 1980, as file No. 89-324031. WHEREAS, public hearings were conducted on the application for time extension on February 4, 1992, and April 7, 1992, and; WHEREAS, the Olivenhain Community Advisory Board considered: 1. The staff reports dated January 30, 1992, and April 1, 1992; 2. The Tentative Parcel Map submitted by the applicant and dated received by the City on November 5, 1991; 3. Oral evidence submitted at the hearings; 4. written evidence submitted at the hearings; and WHEREAS, the Olivenhain Community. Advisory Board made the following findings pursuant to Section 24.50.130 of the City of Encinitas Subdivision Ordinance: (see ATTACHMENT" A" ) NOW THEREFORE, BE IT RESOLVED that a time extension request for Tentative Parcel Map 89-140 is hereby approved subject to the following requirements: JO/02/CROll-910wp511(4/1/92-1) . . . 1. All conditions of Resolution No. OL-90-01 satisfied prior to Final Map approval. shall be Pursuant to City of Encinitas Subdivision Ordinance 24.50.130, the Final Parcel Map must be recorded in substantial conformance to Tentative Parcel Map 89-140 within 12 months of the expiration date of the original approval (February 20, 1993), or this approval will no longer be valid. This time extension approval includes any design review approvals in association with TPM 89- 140; unless future homes to be constructed on the subject parcels are exempt from design review pursuant to section 23.08.030B7 of the Municipal Code. BE IT FURTHER RESOLVED that this project has an Environmental 2. OL-92- CASE NO. 91-187 TPM/EXT Findings section city of of the pursuant to 24.50.130 Encinitas Subdivision Ordinance: 1. The Tentative Parcel Map and conditions of approval remain substantially unchanged. 2. A need exists to attached additional development fees. 3. A need exists to alter map design or number of units. Facts: The request is for a three lot Tentati ve Parcel Map Extension in the RR-2 zone. The property is in an area for single family residential lots of half an acre. The project is to create single family lots and is in compliance with the Zoning Regulations and Land Use Policy Map. Discussion: The Tentative Parcel Map submitted with the extension request is substantially unchanged to the original approved Tentative map. There is no reason why any conditions of Resolution OL-90-01 would need to be deleted. Also, no additional impact fees are required. Condition 2A of Resolution OL-90-01 requires payment of impact fees and is not to be changed. The map extension request is substantially unchanged to the original submittal and no additional lots are being proposed. Conclusion: Therefore, the Tentative Parcel Map Time Extension shall be granted because the minor subdivision is compatible with the land use characteristics of the area and no changes to the original Parcel Map are proposed to be altered.
