1988-24 8 8 8 RESOLUTION NO. OL-88-024 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT (88-297-DR) FOR ONE SINGLE FAMILY DWELLING FOR PROPERTY OF PARCEL 2 OF PARCEL MAP NO. 14086, COUNTY OF SAN DIEGO, AND AS DESCRIBED IN EXHIBIT "A" ATTACHED HERETO (COMMONLY KNOWN AS 2629 LONE JACK ROAD, OLIVENHAIN) WHEREAS, Keith and Deanne Johnson applied for a Design Review permit to allow a single family dwelling unit to exceed the interim height envelope set forth in City Council Ordinance by l' 87-80 2" to the highest peak of the roof and 5' 2" to the top of one chimney cap for property commonly known as 2629 Lone Jack Road, Olivenhain; WHEREAS, public hearings were conducted on the application by the Olivenhain Community Advisory Board on November 22, and December 6, 1988, and all persons desiring to be heard were heard; and WHEREAS, evidence was submitted and considered to include without limitation: a. site plan submitted by the applicant; written information submitted with the application; Oral testimony from staff, applicant, and public made a part of the record at said public hearing; CAB staff reports (88-297-DR) dated November 17, and December 1, 1988 which are on file in the office of Planning and community Development; and Additional written documentation. b. c. d. e. NOW THEREFORE, BE IT RESOLVED by the Ol i venhain Community Advisory Board of the City of Encinitas that the Design Review LN/ln/CAB11a-1089wp (12-1-88) 8 permit for 88-297-DR for one single family dwelling unit is hereby approved subject to the following findings: 1. 2. That the projection out of the building envelope does not significantly impact the views of adj acent properties, in that the project takes advantage of views and/or protects, to the extent possible some of the significant view enj oyed by the residents of nearby properties, since there are no properties directly adjacent to the site that presently have significant views to the east through the site and the structure is located so as to still allow some view through a portion of the site and sone of the significant view of adjacent properties is still maintained. That the project is compatible in structural size (bulk and mass) to adjacent properties and neighborhood, since the proposed structure is of an similar size and bulk as are several other dwelling units in the same vicinity. BE IT ALSO RESOLVED that the Design Review Permit is approved 8 subject to the following conditions: 8 1. Project is approved as submitted and dated December 6, 1988, and shall not be altered without Community Advisory Board review and approval. 2. Prior to the City Building Department issuing a final inspection on framing, the applicant shall provide a survey from a civil Engineer as to the building height. 3. A soils report shall be prepared and submitted upon request for a grading permit. (Soils report CL-1867 shall be submitted to the city with Grading Permit L-0552 (county) and the grading plan.) 4. Final grading plan shall be subject to review and approval by the Department of Public Works and shall be completed prior to issuance of the building permit. 5. Developer shall execute and record a covenant with the County Recorder agreeing not to oppose the formation of an assessment district to fund the installation of ROW improvements to include storm drain improvements. 6. The developer shall pay the Traffic Mitigation Fee if appropriate and depending upon the date of recordation LN/ln/CAB11a-1089wp (12-1-88) 8 8 8 of PM14086 at the established rate at the date the final inspection or the date the certificate of occupancy is issued, whichever ,occurs later. 7. A drainage plan in accordance with the standards set forth by the ci ty of Encini tas and approved by the Director of Public Works shall be re'quired. 8. Concentrated flows across driveways and/or sidewalks shall not be permitted. 9. storm drains will be required at locations specified by the Director of Public Works and in accordance with standard engineering practices. 10. The proposed project falls within areas indicated as subject to flooding under the National Flood Insurance Program and is subject to the provisions of that program and City Ordinance. (This will be applicable if a further study indicates the project is in the designated flooding zone.) 11. An automatic fire sprinkler system shall be installed as per NFPA 13 or 13D.
