A RESOLUTION OF THE OLIVENHAIN
COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW
PERMIT (88-229-DR) FOR ONE SINGLE FAMILY DWELLING FOR
PROPERTY COMMONLY KNOWN AS 1306 RANCHO ENCINITAS DRIVE
WHEREAS,
Stanley and Donna Bienus applied for a Design
Review permit to allow a single family dwelling unit to exceed
the interim height envelope set forth in City Council Ordinance
87-80
for 26'
6 5/8" to the peak of the roof and 27' 6" to
the top of one chimney cap, with a maximum elevation for the
structure at 310.40 elevation, for property commonly known as
1306 Rancho Encinitas Drive, City of
Encinitas;
WHEREAS,
public
hearings
conducted
were
on
the
application
by the Olivenhain Community Advisory Board
on
September 6, and September 20, 1988, and all persons desiring
to be heard were heard; and
WHEREAS, evidence was submitted and considered to include
without limitation:

Site plan submitted by the applicant;
Written information submitted with the application;
Oral testimony from staff, applicant, and public made
a part of the record at said public hearing;
CAB staff reports (88-229-DR) dated September 1, and
September 14, 1988 which are on file in the office of
Planning and Community Development; and
Additional written documentation.

NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community
Advisory Board of the City of Encinitas that the Design
Review
permit for 88-229-DR for one single family dwelling unit
is
hereby approved subject to the following findings:

That the projection out of the building envelope does
not significantly impact the views of adjacent
properties, in that the proj ect takes advantage of
views and/or protects, to the extent possible some
of the significant view enjoyed by the residents of
nearby properties, since the structure is located so
as to still allow view through a portion of the site
and sone of the significant view of adjacent
properties is still maintained.
2.
That the proj ect is compatible in structural size
(bulk and mass) to adjacent properties and
neighborhood, since the proposed structure is of an
estate size as are several other dwelling units in
the same subdivision.

IT ALSO RESOLVED that
the
Design Review
Permit
is
approved subject to the following conditions:

1.
proj ect is approved as submitted and shall not be
al tered without Community Advisory Board reviw and
approval.
2.
Prior to the City Building Department issuing a final
inspection on framing, the applicant shall provide a
survey from a civil Engineer as to the building
height.
The soils/geological/hydrolic report shall be
prepared and submitted upon request for a grading
permit.
3.
Final grading plan shall be subject to review and
approval by the Department of Public Works and shall
be completed prior to issuance of the building
permit.
A drainage plan in accordance with the standards set
forth by the City of Encini tas and approved by the
Director of Public Works shall be required.
Concentrated flows across driveways and/or sidewalks
shall not be permitted.
An automatic fire sprinkler system shall be installed
as per NFPA 13 or 13D.
