1988-20 8 8 8 RESOLUTION NO. 88-020 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD CITY OF ENCINITAS, APPROVING A BOUNDARY ADJUSTMENT TO ALLOW A REALIGNMENT OF A COMMON LOT LINE OF 2 SINGLE FAMILY RESIDENTIAL LOTS LOCATED AT 2250 AND 2282 COLONY TERRACE (CASE NUMBER 88-272/BA) WHEREAS, a request for consideration of a boundary adjustment was filed by Lee Shaw and R.R. Link to allow a realignment of a common lot line of 2 single-family residential lots, as per Chapter 24.70.010 of the City of Encinitas Municipal Code, for the property located at 2250 and 2282 Colony Terrace, legally described as; Parcels 3 and 4 of Parcel Map 8380. WHEREAS, a public hearing was conducted on the application on October 18, 1988; and WHEREAS, the Community Advisory Board/Planning commission considered: 1. The staff report dated October 10, 1988; 2. The proposed General Plan, Local Coastal Program, Zoning Code and maps; 3. Oral evidence submitted at the hearing; and 4. Written evidence submitted at the hearing. WHEREAS, the Olivenhain Community Advisory Board made the following findings Municipal pursuant to Code, section the 24.70.060. PM/04/CRO3-152WP (6-13-89-3) 8 8 8 The parcels result in .57 and .82 acres meeting minimum lot sizes (.5) of the RS-2 zone. The parcels are rectangular in size allowing adequate area for development of a single family home on each lot. The anticipated General Plan proposed 1/2 acre lot sizes resulting in being consistent with the proposed project. The parcels do not extend beyond city boundaries and do not affect any agreement for public improvements. NOW, Olivenhain THEREFORE, by the BE IT RESOLVED Community Advisory Board of the City of Encinitas that the boundary adjustment the is subject hereby approved, to following conditions: SEE ATTACHMENT "B" BE IT FURTHER RESOLVED by the Olivenhain Community Advisory Board of the City of Encinitas that: (1) This project was found to be exempt from environmental review, Section 15305, Class Sa. The project shall comply with Chapter 24.70 of the Municipal Code. 2. The applicant shall comply with the conditions imposed, set monuments on all property corners of the adjusted parcels and have a final record of survey map recorded at the office of the County Recorder. 3. The applicant shall provide copies of the recorded record of survey plat and recorded deeds of ownership, together with evidence of Compliance with conditions and closure calculations of each lot as adjusted. A Certificate of Compliance shall be recorded to complete the process for the approved application. 4. The developer shall pay the traffic mitigation fee at the established rate at the date the final inspection or the date the Certificate of Occupancy is issued, whichever occurs later. 5. Developer shall execute and record covenant with the County Recorder agreeing not to oppose the formation of an assessment district to fund the installation of right-of-way improvements.
