1988-19 8 8 8 RESOLUTION NO. OL-88-019 A RESOLUTION OF OLIVENHAIN COMMUNITY ADVISORY BOARD APPROVING A TENTATIVE PARCEL MAP (87-136-TPM) FOR PROPERTY BEING PARCEL 4 OF PARCEL MAP NO. 12666, COUNTY OF SAN DIEGO, CITY OF ENCINITAS WHEREAS, submitted a Tentative Lone Jack Investment Co. Parcel Map application as required by the City of Encinitas Subdivision Ordinance, for the purpose of subdividing one 7 acre parcel into three lots of 2.3, 2 . 0 , and 2. 3 net acres respectively; and WHEREAS, a public hearing was conducted by the Olivenhain Communi ty Advisory Board on February 2, 1988 as required by law, and all persons desiring to be heard were heard. NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community Advisory Board of the city of Encinitas, that the proposed Tentative Parcel Map for property being Parcel 4 of Parcel Map 12666, County Diego, hereby cit Encinitas, is of of San approved, is following and that approval based upon the findings: a. That the proposed map is consistent with applicable general and specific plans as specified in section 65451 of the Subdivision Map Act. b. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans since the proj ect is in conformance with the General Plan designation for the site. c. That the site is physically suitable for that type of development, in that the two parcels are proposed to be developed in single family dwelling units which is consistent with the RR-.5 zoning designation and development standards for the site. d. That the site is physically suitable for the proposed density of development, since the topography and LN/CABlle-410wp 8 g. design of the lots can be adequately accommodated as proposed. e. That the design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat, and a Negative Declaration is hereby certified for the Tentative Parcel Map (87-136-TPM) on this date, February 2, 1988. f. That the design of the subdivision or type of improvements is not likely to cause serious public health problems, since documentation has been obtained stating that utilities shall be available for the site. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. 87-136-TPM NOW THEREFORE, BE IT RESOLVED that Tentative Parcel Map Declaration is hereby approved, and the associated Negative of Environmental hereby is Impact (87-136-EIA) 8 certified subject to the following conditions: THE FOLLOWING CONDITIONS SHALL BE COMPLIED WITH BEFORE A PARCEL MAP IS APPROVED BY THE OLIVENHAIN COMMUNITY ADVISORY BOARD AND FILED WITH THE COUNTY RECORDER OF SAN DIEGO COUNTY. THE PARCEL MAP SHALL SHOW AN ACCURATE AND DETAILED VICINITY MAP, INCLUDING DISTANCES. 1. GENERAL CONDITIONS A. B. C. D. 8 This approval will expire on February 2, 1991, at 5:00 p.m. unless the conditions have been met or an extension has been approved by the Authorized Agency. This approval may be appealed to the authorized agent within 10 days from the date of this approval. Nothing in this permit shall relieve the applicant from complying with the condi tions and regulations generally imposed upon activities similarly in nature to the activity authorized by this permit; Approval of this request shall not waive compliance with any sections of the Zoning Development Code and LN/CABl1e-410wp 8 8 8 CASE NO. all other applicable City Ordinances in effect at the time of Building Permit issuance. County Health Department APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING AND COMMUNITY DEVELOPMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 2. ROAD DEDICATIONS AND IMPROVEMENT PLANS (DPW) A. Any offer of dedication or grant of right-of way sahlI be free of all encumbrances or subordinated at the time of recordation of the parcel map. B. The 100 year flood plain shall be recorded on the map as an irrevocable offer of dedication for open space and no structutes shall be permitted in that open space. 3. COUNTY SERVICE ARE/ROAD MAINTENANCE/COVENANTS/DEVELOPMENT FEES (DPW) A. The property owners shall acquire a road road maintenance agreement from all property owners for the purpose of maintenance of the private road easements. B. Park development fees shall be collected in accordance with city of Encinitas Ordinance 87-11. C. All applicable fees shall be collected in accordance with city of Encinitas standards as set forth by the City Council. 4. FACILITY/UTILITY ARRANGEMENTS (DPW) A. The subdivider shall comply with section 66436 of the Government Code by furnishing to the city Department of Public Works a certification from each public utility and each public entity owning easements within the proposed subdivision stating that: (a) they have received from the subdivider a copy of the proposed final map; (b) they object or do not object to the filing of the map without their signature. LN/CABlle-410wp 8 E. CASE NO. B. Plans and specifications for the installation of a sewer system serving each lot must be approved by the Director of the Department of Public Works, when required. The subdivider shall dedicate all necessary easements for that portion of the sewer system which is to be public sewer. The SUbdivi4er shall cause all of the land within this subdivision to be annexed to the Cardiff Sanitation District. C. D. A commitment to serve each parcel must be obtained from the Cardiff Sanitation District. No sewer committment shall be issued until all conditions in this Resolution of Approval have been satisfied, the final map or parcel map, grading plan and improvement plan has been approved by the Department of Public Works and all fees and deposits paid and improvement security posted. THE FOLLOWING PUBLIC IMPROVEMENTS MUST BE COMPLETED, OR A SECURED AGREEMENT EXECUTED, PRIOR TO RECORDING A PARCEL MAP. THE AGREEMENT REQUIRES POSTING SECURITY IN THE FORM OF A CASH DEPOSIT, IRREVOCABLE LETTER OF CREDIT OR AN INSTRUMENT OF CREDIT VALUED AT, OR MORE THAN THE ESTIMATE IMPROVEMENT COST. IT ALSO REQUIRES IMPROVEMENTS BE COMPLETED WITHIN 24 MONTHS OF RECORDING THE PARCEL MAP, AND PRIOR TO GRANTING OF ANY APPROVAL OF DEVELOPMENT OF ANY PARCEL CREATED BY THIS MAP, EXCEPT BUILDING AND ASSOCIATED PERMITS CAN BE ISSUED REQUIRING COMPLETION OF PUBLIC IMPROVEMENTS PRIOR TO OCCUPANCY OF THE BUILDING. 8 5. A. PUBLIC ROAD AND PRIVATE ROAD IMPROVEMENTS C. D. -- That Lone Jack Road be improved along the proj ect frontage to a graded width of 32' with 24' of A.C. pavement over approved base with concrete rolled curb at 12 feet from centerline to the satisfaction of the Director of Public Works. B. Improvement of the private access roads to a 20 foot paved width of D.G., in accordance with the City of Encinitas private road standards. That a grading plan be submitted for the private road. All new and existing utility distribution facilities, including cable television lines, shall be placed underground. All utility installations shall be completed before improvement of the public and private roads. LN/CABlle-410wp 8 8 8 6. TRAILS CASE NO. E. Plans for public road improvements shall be prepared by a registered civil engineer and submitted to the Director of Public Works. The following items shall also apply: A. 1. Street alignment and grade, including the change of any existing or proposed street alignment and grade, shall be as required by the Director of Public Works. 2. Sight distance at all intersections shall conform to the intersectional sight distance criteria as provided by the American Association of state Highway and Transportation Officials in the publication "Geometric Design of Highways and Streets - 1984" or its latest revision. 3. Plans and specifications for the improvement of all streets, right-of-way, drainage easements and all culverts, drainage channels and all private easements shall meet with the approval of the Director of Public Works. Dedicate and improve the Riding and Hiking Trail as conditioned below and to the satisfaction of the Director of Public Works. An IOD shall be required wi thin the 100 year flood plain to accommodate a width of 12' for the Riding and Hiking trail and the width necessary to accommodate the creek to the satisfaction of the Director of Community Services, and that the 12' trail rOD shall continue westerly along the north property line of the subject site to connect to the existing trail system on Lone Jack Road. B. The trail surface shall consist of the native soil, or where the soil is highly erosive or will not support the traffic, a tread surfacing material such as decomposed granite. C. Trail gradients shall not exceed 15%. Where natural grades exceed 15% sufficient width for switchbacks shall be provided to accommodate a 15% gradient trail. D. The trail system shall be continuous through the subdivision and shall provide for local access within the subdivision. F. Points where the trail exits the subdivision shall be coordinated with existing or planned trail location on adjacent property. G. Provide signs at trail entrances to provide identification, rules and regulations, and markers along the route to direct the users. THE FOLLOWING PUBLIC IMPROVEMENTS MUST BE COMPLETED, OR A SECURED AGREEMENT EXECUTED, PRIOR TO RECORDING A PARCEL MAP. THE AGREEMENT REQUIRES POSTING SECURITY IN THE FORM OF A CASH DEPOSIT, IRREVOCABLE LETTER OF CREDIT OR AN INSTRUMENT OF CREDIT VALUED AT, OR MORE THAN THE ESTIMATE IMPROVEMENT COST. IT ALSO REQUIRES IMPROVEMENTS BE COMPLETED WITHIN 24 MONTHS OF RECORDING THE PARCEL MAP, OR PRIOR TO THE ISSUANCE OF A PERMIT OR OTHER GRANT OF APPROVAL FOR THE DEVEIDPMENT OF A PARCEL CREATED BY THIS MAP, WHICHEVER OCCURS FIRST UNLESS OTHERWISE NOTED. 7. FLOODING/DRAINAGE IMPROVEMENTS (DPW) A. The subdivider shall pay those flood/drainage fees as adopted by the City of Encinitas City Council. 8. FACILITY/UTILITY IMPROVEMENT A. The subdivider shall install the sewer system and dedicate the portion of the sewer system which is to be public sewer where appropriate as shown on the approved plans and specifications. 9. FIRE A. That one residential fire hydrant be provided to be located at the north boundary of parcel 2 at the edge of the access easement. B. That a fire flow of not less tha 1500 G.P.M. IS be provided. C. That the property must annex into the Encinitas Fire Protection District prior to recordation of the Parcel Map. LN/CABlle-410wp 8 8 . CASE NO. 10. GENERAL REQUIREMENTS AND APPROVALS A. That the parcels shall be developed as custom lots, and shall only be approved for grading necessary to construct a standard single family dwelling and required parking built into the contours of the lots. A standard covenant shall be recorded on all three parcels in the office of the County Recorder to run with the land restricting development as stated above.
