RESOLUTION NO. OL-88-018
A RESOLUTION OF THE OLIVENHAIN
COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW
PERMIT (88-218-DR) FOR ONE SINGLE FAMILY DWELLING FOR
PROPERTY OF PARCEL 2, PAGE 12075 OF PARCEL MAPS,
COUNTY OF SAN DIEGO,
(COMMONLY KNOWN AS 1109 CANARY LANE, OLIVENHAIN)
WHEREAS, Fred Reva applied for a Design
Review permit to
allow a single
family dwelling unit to exceed the
interim
height envelope set forth in City Council Ordinance
87-80
for
property
commonly
known
City
1109
Canary
Lane,
of
as
Encinitas;
WHEREAS, a public hearing was conducted on the application
by the Olivenhain Community Advisory Board
on August 2, 1988,
and all persons desiring to be heard were heard; and
WHEREAS, evidence was submitted and considered to include
without limitation:
a.
site plan submitted by the applicant;
written information submitted with the application;
Oral testimony from staff, applicant, and public made
a part of the record at said public hearing;
CAB staff report (88-218-DR) dated July 29, 1988
which is on file in the office of Planning and
Community Development; and
Additional written documentation.

NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community
Advisory Board of the City of Encinitas that the Design
Review
permit for 88-218-DR for one single family dwelling unit
hereby approved subject to the following findings:
is
1.
The project design does preserve significant public
views to the extent possible, and offers mitigation
for lost views, since the single family structure
proposed is of a standard size for the neighborhood

and encroachment above the 26' height limit will not
unduly block views because the surrounding properties
do not presently have significant view through the
site;
2.
The project takes advantage of views and/or
protects, to the extent possible, some of the
significant view enjoyed by the residents of nearby
properties, since the site is lower than the
surrounding properties and no significant view
presently exists from view windows through the site;

approved subject to the following conditions:
IT ALSO RESOLVED that the Design Review Permit
is
1.
Project is approved as submitted and shall not be
altered without Community Advis~ry Board reviw and
approval.
Prior to the City Building Department issuing a final
inspection on framing, the applicant shall provide a
survey from a civil Engineer as to the building
height.
