1988-16 8 8 8 RESOLCTION NO. OL-88-016 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT (88-187-DR) FOR 28 SINGLE FAMILY DWELLINGS FOR PROPERTY AS DESCRIBED IN "ATTACHMENT A" AND LOCATED ON THE NORTH SIDE OF MANCHESTER AVENUE BETWEEN PACIFIC RANCH DRIVE AND TRABERT RANCH ROAD WHEREAS, Davidson Pacific applied Design for a LTD, Review permit for 28 single family dwelling units on 28 lots with 2 open space lots, and to allow the chimneys of one of the proposed models which will be constructed on several lots to exceed citywide City Council Ordinance interim 87-80 the development height limit of 26' by l' for property as described in "Attachment A" and located on the north side of Manchester Avenue between Pacific Ranch Drive and Trabert Ranch Road; and WHEREAS, public hearings were conducted on the application by the Olivenhain Community Advisory Board on July and 19 August and all desiring to be heard were 2, 1988, persons heard; and WHEREAS, evidence was submitted and considered to include without limitation: a. b. c. site plan submitted by the applicant; written information submitted with the application; Oral testimony from staff, applicant, and public made a part of the record at said public hearing; CAB staff reports (88-187-DR) dated July 13, and July 28, 1988 which are on file in the office of Planning and community Development; and Additional written documentation. d. e. LN/CABllc-068wp (1-31-89) ~ ""'" BE :~ RESOLVED DY the O::venha:n C~~~~~:ty NO\\" THEREFORE, Review Advisory Board of the City of Encinitas that the Design 8 permit units and two open space lots is hereby approved subject to the family dwelling for 88-187-DR for twenty-eight single following findings: 1. 8 8 The project design does preserve significant public views to the extent possible, and offers mitigation for lost views, since subj ect site is located in a canyon and is lower than surrounding properties little views exist through the site at present for properties directly adjacent to the site. The design of the structures is compatible with the surrounding area, each other, and the character of Olivenhain, since they are of similar size and architectural style. Public views are defined as those views provided from public property; 2. The project takes advantage of views and/or protects, to the extent possible, some of the significant view enj oyed by the residents of nearby properties, since the project is being proposed within the 26' interim height limit except for some of the chimneys and little view exists through the si te from north to south or west to east and does exist of the site and over the site. 3. That the proposed proj ect is in conformance with section 23.08.72 of the Design Review Ordinance, since the project is consistent with the existing and proposed General Plan in land use allowing one dwelling unit per 2 acres and all utilities are available to the site; 4. That the proposed project is in conformance with section 23.08.74 of the Design Review Ordinance, since the proj ect was designed to retain the open space in its natural state and cluster the home sites along the roadway; 5. That the proposed project is in conformance with section 23.08.76 of the Design Review Ordinance, since the exterior materials for the proj ect have been coordinated to be compatible with each other and the surrounding area, and the proposed structures are compatible with the size and scale of other single family structures in the surrounding neighborhoods LN/CABllc-068wp (1-31-89) 8 8 8. 6. BE approved A. and they will be of a lesser height; That the proposed project is in conformance with Section 23.08.77 of the Design Review Ordinance, since the project is native tree planting in the landscape plan and the open space lots will retained in their natural vegetation. IT ALSO RESOLVED, that the Design Review Permit is with the following conditions: The project is approved as submitted with only the chimneys for plan B encroaching above the 26' interim height limit by l' and shall not be altered without Community Advisory Board review and approval. B. Prior to the City Building Department issuing a final inspection on framing, the applicant shall provide to the Department of Planning and Community Development a survey from a civil Engineer as to the building height in conformance with this Design Review approval. c. That all structures shall be protected by automatic fire sprinkler systems per NFPA 13-D. D. All two-way traffic aisles shall be a minimum of 24' wide and emergency access shall be provided, maintained free and clear, a minimum of 24 feet wide at all times during construction in accordance with Fire Department requirements. E. Water and sewer systems shall pass all tests prior to delivery of combustible materials on site. required building F. All designated emergency access roads shall be posted per the Fire Department. G. That appropriate noise level tests be taken on Lot 28 to determine what attenuation measures shall be required to meet acceptable decible requirements, and that the proposed noise attenuation measures be returned to the CAB for review and approval.
