1988-14 8 8 8 RESOLUTION NO. OL-88-014 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT (88-142-DR) FOR FOUR SINGLE FAMILY DWELLINGS FOR PARCELS 1,2, 3, & 4 OF PARCEL MAP 10045 (COMMONLY KNOWN AS CRYSTAL RIDGE ROAD, OLIVENHAIN) WHEREAS , Fallon Development, Inc. applied for a Design Review permit to allow 4 single family dwelling units no portion of the structures encroaching into the interim height envelope in City Council Ordinance set forth 87-80, for property described as Parcels 1, 2 , 3, and 4 of Parcel Map 10045, County of San Diego; and WHEREAS, a public hearing was conducted on the application by the Olivenhain Community Advisory Board on June 7, June 21, and July 19, 1988, and all persons desiring to be heard were heard; and WHEREAS, evidence was submitted and considered to include without limitation: a. b. site plan submitted by the applicant; written information submitted with the application; Oral testimony from staff, applicant, and public made a part of the record at said public hearing; CAB staff reports (88-142-DR) dated June 3, June 17, and July 11, 1988 which are on file in the office of Planning and Community Development; and Additional written documentation. c. d. e. NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community Advisory Board of the City of Encinitas that the Design Review permit for 88-142-DR for four single family dwelling units is LN/ln/CAB11-763Awp (6-28-88) hereby approved subject to the following findings: 8 8 4. 5. 8 1. The project design does preserve significant public views to the extent possible, and offers mitigation for lost views, since subject site is at a higher elevation than surrounding properties little views exist through the site at present for properties directly adjacent to the site. The design of the structures is compatible with the surrounding area and each other, since they are of similar size and architectural style. Public views are defined as those views provided from public property; The project takes advantage of views and/or protects, to the extent possible, some of the significant view enjoyed by the residents of nearby properties, since the project is being proposed within the 26' interim height limit except for the chimneys and little view exists through the site from north to south due to the graded slopes on the north and south sides of the property that are presently a higher elevation than adjacent properties to the north and south, and no more of the view of the graded slope on the east side of the property will be visible for the properties to the west of the subject site with the proposed design having the chimneys exceed the 26' than with the roof peaks and the chimneys totally within the 26' interim height limit. 2. 3. That the proposed proj ect is in conformance with Section 23.08.72 of the Design Review Ordinance, since the project is consistent with the existing and proposed General Plan in land use allowing one dwelling unit per .5 of an acre and all utilities are available to the site; That the proposed project is in conformance with Section 23.08.74 of the Design Review Ordinance, since the project is consistent with the previously approved Negative Declaration for grading of the four lots approved by the Olivenhain CAB on October 20, 1987; That the proposed project is in conformance with Section 23.08.76 of the Design Review Ordinance, since the exterior materials for the proj ect have been coordinated to be compatible with each other and the surrounding area, and the proposed structures are compatible with the size and scale of other single family structures in the surrounding neighborhoods since they will be of a lesser height; LN/ln/CABll-763Awp (6-28-88) 8 . 8 approved E. F. G. H. I. 6. That the proposed project is in conformance with Section 23.08.77 of the Design Review Ordinance, since the project is proposing lot perimeter landscaping and will be planting the slopes as required for mitigation in the Negative Declaration approved on October 20, 1987 by the Olivenhain CAB. BE IT ALSO RESOLVED, that the Design Review Permit is with the following conditions: A. The project is approved as submitted with no portion of the structure encroaching above the 26' interim height limit as shown on plans dated July 19, 1988, and shall not be altered without Community Advisory Board review and approval. B. Prior to the City Building Department issuing a final inspection on framing, the applicant shall provide to the Department of Planning and Community Development a survey from a civil Engineer as to the building height in conformance with this Design Review approval. C. That 1 bronze commercial-residential fire hydrant be installed with a minimum GPM of 1500 GPM. D. That Blue dot reflective markers 4" to 6" from center line on hydrant side be installed. All two way traffic lanes be a minimum of 24'. Underground water mains shall be installed to the satisfaction of the Encinitas Fire Protection District. Water and sewer systems shall pass all required tests prior to delivery of combustible building materials on site. A 40' minimum paved radius on the cul-de-sac shall be required. Street improvements to be in conformance with applicable portions of the San Diego County private road standards and the City of Encinitas minimum design requirements to include the following: 1. Construct 6" asphaltic concrete berms. LN/ln/CABll-763Awp (6-28-88) 8 . 8 J. K. 2. Construct 4" asphaltic untreated rock base. 2 /6" CL. concrete 3. Provide drainage study showing the impact of drainage surface flows and the impact, if any, on adjacent properties. 4. Construct improved concrete swales where necessary along the north and south sides of the property to the satisfaction of the City Engineer. That a covenant be recordec;1 in the office of the County Recorder on each lot requiring that the landscaping be planted and maintained by the property owners of each lot for landscaping/planting on the lots and on the slopes as approved on the grading plan slope planting plan dated April 21, 1988, and the lot landscape plan dated April 20, 1988. That the architectural features wrap around to the side and back of the structures, to include the treatments around the windows. L. That the landscaping on the slopes be larger than just groundcover and that it be of draught tolerant species.
