1988-11 8 8 8 RESOLUTION NO. OL-88-011 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT (88-303-DR) FOR ONE SINGLE FAMILY DWELLING FOR PROPERTY COMMONLY KNOWN AS 2530 TETEN WAY WHEREAS, Bruce wiegand applied for a Design Review permit for 2 single family dwelling units with one unit (2550 Teten Way) to exceed the interim height envelope set forth in City Council Ordinance for property commonly known as 2530 87-80 and 2550 Teten Way, Encinitas; and WHEREAS, a public hearing was conducted on the application by the Olivenhain Community Advisory Board on November 22, 1988, and all persons desiring to be heard were heard; and WHEREAS, evidence was submitted and considered to include without limitation: a. site plan submitted by the applicant; written information submitted with the application; Oral testimony from staff, applicant, and public made a part of the record at said public hearing; CAB staff report (88-303-DR) dated November 17, 1988 which is on file in the office of Planning and Community Development; and Additional written documentation. b. c. d. e. NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community Advisory Board of the City of Encinitas that the Design Review permit for 88-303-DR for ONE single family dwelling unit at 2530 Teten Way is hereby approved subject to the following findings: 1. That the projection out of the building envelope does not significantly impact the views of adjacent LN/CAB11b-1090wp (1-9-89) 8 2. 8 approved 8 properties, in that the proj ect takes advantage of views while maintaining some of the significant views enjoyed by residents of nearby properties, since the topography of the site, and the design of the homes still allows some significant views to be retained through the sites. That the proj ect is compatible in structural size (bulk and mass) to adjacent properties and neighborhood, since they are of similar size and architectural style. 3. That the proposed proj ect is in conformance with section 23.08.72 of the Design Review Ordinance, since the project is consistent with the existing and proposed General Plan in land use allowing one dwelling unit per .5 of an acre and all utilities are available to the site; 4. That the proposed project is in conformance with section 23.08.74 of the Design Review Ordinance, since the project is consistent with the previously certified Negative Declaration for TPM 18705; 5. That the proposed project is in conformance with section 23.08.76 of the Design Review Ordinance, since the exterior materials for the project have been coordinated to be compatible with each other and the surrounding area, and the proposed structures are compatible with the size and scale of other single family structures in the surrounding neighborhoods and they will be of similar heights; BE IT ALSO RESOLVED, that the Design Review Permit is A. with the following conditions: The proj ect is approved as submi tted on the plans dated September 20, 1988 on file in the Department of Planning and Community Development, and shall not be altered witho.ut Community Advisory Board review and approval. B. Prior to the City Building Department issuing a final inspection on framing, the applicant shall provide to the Department of Planning and community Development a survey from a civil Engineer as to the building height in conformance with this Design Review approval. That a plan be submitted for approval by the Director of Planning and Community Development, the city Engineer, and the Encinitas Fire Protection District regarding the treatment of the site during the construction phase, and the circulation and parking of construction workers' vehicles and any heavy equipment needed for the construction of the project. D. That th~ color scheme of the structure at 2530 Teten Way be changed to an adobe shade and that the new colors be submitted for review and approval to staff. E. That the Design Review of the structure at 2550 Teten Way be continued to the meeting of January 17, 1989 to allow the applicant time to redesign the structure to be more compatible with the neighborhood, and to reduce the bulk and mass of the structure on the site.
