1988-04 . . . RESOLUTION NO. OL-88-004 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT (88-066-DR) FOR ONE SINGLE FAMILY DWELLING FOR PROPERTY OF THE NORTHERLY ONE-QUARTER OF BLOCK 27, COLONY OLIVENHAIN, MAP 326, COUNTY OF SAN DIEGO, (COMMONLY KNOWN AS 2510 TETEN WAY, OLIVENHAIN) WHEREAS, Bruce D. Wiegand applied for a Design Review permit to allow the chimney of a single family dwelling unit to exceed the interim height envelope set forth in City Council Ordinance 87-69 by l' for property commonly known as 2510 Teten Way, City of Encinitas; WHEREAS, a public hearing was conducted on the application by the Olivenhain Community Advisory Board on April 5, 1988, and all persons desiring to be heard were heard; and WHEREAS, evidence was submitted and considered to include without limitation: a. b. Site plan submitted by the applicant; Written information submitted with the application; Oral testimony from staff, applicant, and public made a part of the record at said public hearing; CAB staff report (88-066-DR) dated March 31, 1988 which is on file in the office of Planning and Community Development; and Additional written documentation. c. d. e. NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community Advisory Board of the City of Encinitas that the Design Review permit for 88-066-DR for one single family dwelling unit is hereby approved subject to the following findings: 1. The project design does preserve significant public views to the extent possible, and offers mitigation for lost views, since the single family structure proposed is of a standard size for the neighborhood and the l' portion of the chimney that exceeds the LN/ln/CABll-594wp (3-31-88) . . . allowable 26' height limit is very small with the majority of the roof peak is at 24' which is two feet less than the 26' height limit; 2. The project takes advantage of views and/or protects, to the extent possible, some of the significant view enjoyed by the residents of nearby properties, since the proj ect has been situated on the lot so as not to block views and because the site is higher than the surrounding properties and no view presently exists from view windows through the site; BE IT ALSO RESOLVED that the Design Review Permit is approved subject to the following conditions: 1. proj ect is approved as submitted and shall not be altered without Community Advisory Board reviw and approval. 2. Prior to the City Building Department issuing a final inspection on framing, the applicant shall provide a survey from a civil Engineer as to the building height.
